Hey guys, i'm about to file for AOS this week and just wanna check if i am missing something in my cover letter. Check this out smile.png

Enclosed please find Form I-485 Application to Register Permanent Residence or Adjust Status, Form I-864 Affidavit of Support, Form I-131 Application for Travel Document, Form I-765 Application for Employment Authorization and all supporting documents. My eligibility is based on admission as the fiancé of a U.S. citizen and subsequent marriage to that citizen within 90 days of entry.

· Copy of federal income tax return, including W-2's for the years 2011, 2012, 2013

· Copy of most recent pay stubs

· Copy of U.S. spouse passport page

I-765 Application for Employment Document

· Copy of Passport with nonimmigrant visa

· Copy of Electronic Form I-94

· Certified copy of Marriage Certificate (to note the name change)

I-131 Application for Travel Document

· Form I-131 Application for Travel Document

· Copy of Passport with nonimmigrant visa

· Copy of Form I-797 Notice of Action (Approval Notice)

· Copy of Electronic Form I-94

· Two (2) Passport size photos

· Certified copy of Marriage Certificate (to note the name change)

Copies of documents submitted are exact photocopies of unaltered documents and I understand that I may be required to submit original documents to an Immigration or Consular officer at a later date.

HI! THANKS for this info! Quick question though<: Do i have to send all the documents (i485,i86,i765 and i131) altogether at P.O. Box 805887

Chicago, IL 60680-4120 in just one envelope? what about the address at 31 rochester ave NH for the i864?

Thanks this is very helpful as we are getting ready to send the similar package in right now. Just one question: Does the marriage certificate need to be a Certified Copy? According to the I-485 Instructions it seems that just a regular xerox copy would be fine.

A regular photocopy of the certified marriage certificate you receive from the court.

If you have K2 filing with K1 for Adjustment of Status do you need two I-485 forms? Also, if K2 is only 5 years old, does she need to have EAD?

Yes, they need their own. The fees are here > http://www.uscis.gov/i-485

If you want the child to get an SSN as soon as possible, then yes, file for an EAD for them too. You can use the EAD to get them an SSN while waiting for them to get a green card.

Certificate. You need a copy of the marriage certificate you receive from the court after your marriage has been registered.

To clarify, are there certain documents that you need multiple copies of (such as copy of passport, copy of marriage certificate, etc) that you put a copy of in each section? Like a copy of the non-citizen passport goes in the pile for the I-485, one copy goes in the pile for the I-765 stuff, and another goes in the pile for the I-131 stuff and then you stack all the sections together? Because I've been following the Step-by-Step Guide (http://www.visajourney.com/content/k1k3aos) especially the assembly instructions and it makes it seem like I only needed one copy of the non-citizen passport (shown as item # 4 on the list) if that makes sense. Basically- should each form have all of it's own separate documents, even if that means that the AOS packet you send in ends up having multiple copies of the same document, or do those forms (I-485, I-765, I-131) "share" all of the same supporting documents?

I was confused about this and asked the same question a few weeks ago. The answer is yes, you need to duplicate the documents for each form that requires them.

This was my question too! I'm so glad you asked because I had not yet made multiple copies of the same document for each separate form. Back to the copy machine I go!

Don't know if it's said earlier because I'm in the process of writing the cover letter as we speak but I want to point out that at the Infopass I had with USCIS they told me to send the original NOA2 and not the copy.

The only documents you need for the EAD and AP are:

EAD

  • 2 passport pictures
  • Copy of bio page in your passport

AP

  • 2 passport pictures
  • Copy of bio page in your passport
  • Copy of your K-1 visa

Don't know if it's said earlier because I'm in the process of writing the cover letter as we speak but I want to point out that at the Infopass I had with USCIS they told me to send the original NOA2 and not the copy.

You only need to send in a copy. You should always keep the original for your records. We only submitted the copy and there was no issue at all.
