Timeline

He should have filed Married filing separate from everything I've read up on the subject. That's how I've filed the last two years as my wife has no tax ID (SSN) and we decided not to get her a tax ID number. I

I'm not a tax expert, but I would think he could amend his return with the proper filing status.

8/31/2012 Married in NE
2/19/2013 I-130 petition sent to Phoenix via USPS
2/20/2013 I-130 NOA1 via text and email with an MSC receipt number
10/16/2013 I-130 NOA2 via text and email...APPROVED at MSC!!!
10/22/2013 I-130 NOA2 hard copy received in the mail
11/7/2013 NVC sent emails with case number.
11/7/2013 Received DS-3032 / I-864 Bill
11/11/2013 Paid I-184 Bill
11/18/2013 Paid IV Application Processing Fees
03/03/2014 DS-260 was submitted online
03/03/2014 Submitted supporting documentation for I-864 and DS-260 (IV Package and AOS supporting documentation)
03/19/2014 Received receipt e-mails stating the documents for both I-864 and DS-260 had been attached to the case. Stated to wait up to 20 business days for processing
03/26/2014 Received a checklist regarding the birth certificate. This was previously provided in an email. Investigating what was wrong with the birth certificate.
03/26/2014 Called the NVC and was told this was likely because we accidentally submitted a "short form" birth certificate rather than a "long form", but we knew that wasn't the case.
03/26/2014 Wife called back to NVC and they told her that it was because the form was "too decorative". The lady on the phone told her to wait 25 days as she'll forward it to a supervisor.
04/04/2014 Email received with a CASE COMPLETE notification and P4 interview letter.
05/21/2014 Scheduled Interview Date.
5/21/2014 VISA APPROVED!!!!

07/04/2014 Sent renewed passport to Montreal consulate for visa placement due to old passport expiring.
07/18/2014 Visa status set to "Issued" on CEAC website.
09/29/2014 Entry to the United States.

09/12/2016 I-751 Filed to California Service Center
09/16/2016 I-751 NOA1 Recieved, Green Card Extended 1 Year
10/13/2016 Biometrics screening completed

I'm not a tax expert, but I would think he could amend his return with the proper filing status.

Ok, I already told him to file married- separate but the tax lady told him that he needs to file single since that I am not in the U.S and no SSN. Hope we can fix this issue. What to put on the SSN spouse question since that I don't have SSN? Thanks

When I file I put my wife's name where it asks and then I put "NRA" for non-resident alien in the spouse tax ID field. That's what it says to do in the instructions.

He'll have to file a paper return to do this.

Thanks. I am going to ask him to fix it asap. I am just worried that it might affected the process. I also read that he can amend it?

The tax lady likely just wants the money. He has to print the form off, write NRA in your SSN spot and mail the tax return. She doesn't get her money if he doesn't efile most likely.

The impact to your immigration process will be minimal, if at all.

However, he should amend his tax return to MFS by filing Form 1040X, printing 'NRA' where it asks for your SSN. As he won't be claiming any exemptions for you, it's not needed anyway. He may even realize a lower tax burden.

The tax lady he went to is simply wrong and incompetent. Wouldn't be one of those fly-by-night both attendants at WalMart, Sears or the mall, would it?

What amuses me is that the tax payer (and tax preparer, if used) sign the end of the form, just under a statement that reads "Under penalties of perjury, I declare that I have examined this return and accompanying schedules and statements, and to the best of my knowledge and belief, they are true, correct, and complete. …' claiming one is 'single' when they are 'married' is a false statement.

Yeah, you can fix it. File the amended tax return … IRS Form 1040X.

Do you have a copy of his single tax return? If so, take the data and recalculate the tax as MFS … if there is a lower tax liability (i.e., greater refund potential), then you can point it out to him that his tax lady is costing him a lot more than the preparation fee … it's (potentially) costing him unnecessary additional tax dollars … and since you now know more about taxes, you'll be handling the tax returns in the future. Ha!

Now I am worried. Can we still fixed this right? He filed it last month.

My husband file single ever since we are married. We ask the person filing his taxes about our situation and he said it's okay to file as single and we can Amend it after I get my SSN and no problem with the process. As of this time I am waiting for my interview.

There is no need to worry. IRS isn't going to make an issue of it unless they feel you are doing so with the intent of paying less tax than you should.

I just don't think it is right to lie, especially when there is an alternative, correct way of doing things.

Yes, you can fix it ... as noted above ... file a 1040X amended return. It's very easy.
