Domestic violence case dismissed and previous petition for I-130

I am about to put together the K-1 Visa petition packet and mail it but before I finalize all the documents I have a couple of questions.

First off.... I was previously married from 2000- 2006 and was arrested for domestic violence and spent the night in jail. I never hit him much less touched him in any way. When i went to court i told the judge that i never hit him and it showed up on the paper as Domestic Violence 3rd degree-Menacing. (All we did was argue and I called the police because he took my car keys and wouldn't let me leave). Well the judge threw out my case and dismissed the charges but it still shows up on my record.

On the Petition for Fiance (I-129F) it asks if I have ever been convicted by a court of law for domestic violence. I checked "No" because i wasnt convicted (it was dismissed) but how should i handle that? Should i enclose a copy of the dismissal or just check "No" and leave it at that?

Also, in my previous marriage, he was not a legal resident. After we married I filed Form I-130, Petition for Relative Alien. It was as far as we went with filing any paperwork. I received an approval notice but we never filed the next step.

In the I-129F it asks "have you ever filed for this or any other alien fiancè or husband before?" How should I answer that? We were married for a year (together for 7 years) before we filed that I-130. Even though it was a Petition for Alien Relative in 2001 do I still need to disclose it?

Yes you need to disclose the previous time you filed an i130

You need send the police record,

Read the intructions they say that you need show proof of your record even if you were decharge.

Check No and include a copy of the dismissal, just to be safe and have all your bases covered.
