General I-129F Questions/Concerns

Hello,

My fiance and I are about to start the process of the I-129F/K-1 Visa application. We got engaged a few weeks ago while I was abroad visiting her in South Korea, and she is currently here visiting me in the US. She entered on the VWP, and I was advised that we could simply get married while she was here on the VWP then apply for an AOS to a green card, however after looking into this in more detail it seems like a far too risky venture. So, we've decided that we'll go forward with the I-129F application, although I had a few issues that I wanted to clarify before sending in the application:

1. How long can my fiance stay in the states before having to go back to Korea? Her VWP entry will let her stay here until May 23, and from what I can tell the only time she will need to be in Korea is for her K-1 interview which seems to be several months after the process is started. Could anyone provide a bit more information on this subject for me?

2. Evidence that we intend to marry within 90 days - On the instructions it says that we can submit a "statement of intent to marry", but is this statement alone sufficient evidence?

3. Just to confirm that I've got the adequate document list correct (neither of us have been married before and no kids):

I-129F Application

$340 check

Copy of my certificate of citizenship

Evidence of intent to marry (hopefully just statement of intent)

Evidence that we've met up in the past 2 years (plane ticket receipts, passport stamp copies, etc.)

2 completed G-325A forms (any additional fee required for these?)

1 passport photo each

Sorry for the exhaustive list of questions, but this was a pretty quick decision that we made and we're hoping to have everything submitted ASAP. This being the case, any help that you guys could provide would be hugely appreciated.

Hi,

I suggest having a look at the example forms. You will need to include a copy of your passport and also i recommend sending a cover letter. Your fiancee can stay until May 23 if she wants. it's not a problem. The letter of intent is a simple letter saying I Eoghan (last name) intend to marry (fiancee's first and last name) within 90 days of her entry in the united states on her k-1 visa" then you sign your name in blue or black ink. She sends the same letter in the package but obviously with names and gender reversed. no additional fee for the g forms.
