help to decide what visa is to apply

my boyfriend and i are planning to be together. weve been in a relationship for 3 years, we are blessed to have a baby girl which i gave birth 2yrs ago. i was pregnant when he went back to the US. during those times , i am not yet legally separated. my annulment was filed just a year ago and waiting for it to be granted. i am working now in abroad(ksa) while we are waiting for the right time. but as time goes by, i feel so lonely and wanting to be with him even just for a day. i cant wait for forever not to see him right next to me. we wanted to go through in legal process to be together. but now, we are thinking what is the best plan to do , i want to visit him and be with him desperately even for such a short period of time. we know he cant petition me as his fiancee bec i am still considered married and not as free as a bird. what is the best thing to do? will i try to apply a tourist visa together with our child? or just wait until he can petition us in the right time? but honestly, i know in my heart that i need to be with him soon, and i cant wait too long . (i love him so much :( )

I would say wait until you are legally annulled or divorced, then have him file the K-1. It is much faster than filing CR-1.

Have you guys met face to face within the last two years? Because that's definitely a requirement. At least for the K1 visa

Your boyfriend cannot file anything for you. He can file for a K-1 after your annulment is final.

You can apply for a tourist visa based in your own circumstances. Your BF cannot do anything to help you get a tourist visa.

If your child is a US citizen (or has a claim to US citizenship based on a USC father), then he needs a US passport to enter the US.

hi! @darnell, what is a EB-5 visa? sorry but i dont know any about this. thanks for your time to comment on my post. i really appreciate it.:)

Darnell likes to throw stupid ideas out there.

Not the first time he suggested EB-5.

An EB-5 is for a foreign investor who wants a green card. $500,000 investment in a Regional Center or $1,000,000 for another business.

Not too many people are going to be able to afford the EB-5 route.

no i could say, the last time we've been physically together was august of 2011. from then on, the only thing that keep us on track was the internet chats/ calls . is there any problem about that.? thankusomuch pretty.:)

The best Visa is the one you choose. The K-1 & CR-1 both have pros and cons. Have a look at this guide for a quick run down of each. http://www.visajourney.com/content/compare

Some K-1 filers myself included will say if we had to do it again, we would do the CR-1 instead. Don;t be lured by the shorter process time of a K-1. You have additional work and expense when you get here. Additionally, you may find your relationship is scrutinized more heavily when filing for a K-1.

Read the guide, ask questions, take your time.

Yes big problem. You HAVE to have met within 2 years PRIOR filing. It's a requirement that can hardly be overcome. They won't accept your papers

Well, it can be overcome by a trip to visit. Either way, they need to meet to get married or meet to qualify for the K-1. A trip is inevitable.
