If you don't get married within the 90 days then you can't adjust, if you get married within the 90 days but don't file until after the 90 days then you can still adjust and that overstay will be forgiven but just like in this case you are at risk if your I94 expires before you file and can be detained.

A K-1 can adjust if they marry beyond the 90 days, but they need to submit a I-130 when doing so and file a normal AoS packet (unlike K-1s who marry within the 90 days, who only have to submit an I-485 and its supporting documentation).

Hi there. I am looking for some advice...My husband who came in on a fiance visa was detained today and is being held in a deportation facility in Texas. He was on a bus that was pulled over by Border Patrol and his visa is expired. We got married within the 90 days, but we have not filed for AOS yet,because we were trying to get his daughter here and were told there is no deadline to do so...What can I do? I am looking for a lawyer but I love this forum and used it when we were trying to get him here. I was unable to access my old account but i wanted to come here to ask. Would it do any good to file the AOS now? What is going to happen to him? I am grateful in advance to anyone that can shed some light on this for us. Take care, Deb

so when/if the fella gets in front of a judge at a bia court,

if'n he's lucky, the judge will find that he's in an AOS-able condition,

and render a ruling that THEY file the AOS set within 90 days.

if'n he's lucky...

certainly having an immigration lawyer that specializes in this stuff, to remind the judge of this AOS-able condition, can't hurt a bit !

For sure, its a burden, and a hell of a way to start off a marriage, already running around trying to find a judge to get married in the first place then to rack your brain filling out all those forms. Then another complete set for each child you bring here, and that big fat check they want. Trying to find a USCIS approved doctor that wouldn't rob us to death was a nightmare for that I-693. And I did forget, you cannot extend your visa with an I-539.

But we got it done and received our NOA with about 31 days to spare. It also came with biometrics appointments, another 450 mile trip for us. But then they gave us about a years break waiting for our AOS interview.

We also sent in an extra 600 bucks for EAD cards for the two of them, without that, can't do anything, not even open a one dollar bank account. Also was in the twilight zone sending a child to school, supreme court says you can, DOS says you can't, but she was safe with an EAD card.

Was some tension during the AOS, went through all of this, lived here for well over a year, and wondered if they would let my wife and stepdaughter stay,

As I said, a hell of a way to start off a marriage.
