Hello everyone,

I have questions on my recent I-751 application.

My application was sent to VSC on 1/11/06 and received on 1/12/06.

The fee was cashed on 1/19/06. It has been almost 3 weeks and I still have not received NOA.

I know sometimes it could take a month for it to be received, but my GC is going to expire on 2/17/06.

Now, I started to wonder it might have sent to my old address.

I moved to current address right after I received my conditional GC, which was 2 years ago. I filed for the change of address then, but do not know if that is reflected on my record.

I put my current address on my I-751 form.

Does anybody know if NOA is sent to address on I-751 or address registered to my GC?

( I moved within the building, so the service center would have been VSC either way)

Also, if there is anybody who filed I-751 at VSC recently, would you please post your timeline for the first NOA?

They will send the NOA to the address that you put on the I-751 form. You just have to wait...

Did you get delivery confirmation on your package. If you haven't received it by the time that your GC expires, make an Infopass Appointment with the proof that you sent in your I-751 by either the delivery confirmation or the cancelled check and ask for an I-551 stamp.

Yes, I have delivery confirmation and copy of the check they cashed with receipt number on.

As you recommended, I made an Infopass Appointment on 2/13, which is 31st day of my filing and 5 days before the expiration of my GC.

Hopefuly, NOA will come before my Infopass Appointment, but it's very reassuring to know that I have a second plan.

BTW, it might not be a big deal, but when I made an Infopass Appointment, there were several choices for the reason of requesting appontment. What should I choose for my situation?

Can I just check on " You have received an approval letter or Form I-797 from the Service Center or local office instructing you to come into the office for alien identification card processing / passport stamp."?

Actually that response would not apply.. you should choose the option that you wish to speak to an officer about your case.

From what I have gathered now is you really don't need the stamp unless you are planning to leave the country on a trip anytime soon (before your actual GC arrives). You should have gotten a letter saying your current card has been extended for a year. That's all you need to have now.

Like I mentioned, if you are planning on leaving in the next year out of the country, then you would need the stamp in the passport.

Your CG can be anywhere from a week to many months away. I'm not sure how VSC is, so if you don't recieve your GC by next year, you would have to make another infopass appointment to get another year extension...

Actually, my employer has been asking me for the 1st NOA extending my GG 1 year.

I really dont know why the 1st NOA taking so long to come. It seems most people get it within 2 weeks.

Anyway, I read somewhere I dont need to get a stamp for my employer even though I dont have NOA if I have an unrestricted SS card and driver's license, but I am not sure.

Do you know if I need a stamp to show my employer as a physical evidence if I dont have NOA by the time my GC expires.

BTW, how long did it take for you to get 1st NOA?

It has been already 3 weeks, and I am not sure if I'm ever gonna receive it.

You DO NOT need to show your employer anything. All you need is (1) unexpired proof of identity and (2) proof of work eligibility. If both your license and SS card are unrestricted, then that is all that is required.

Basically, though, it says they HAVE TO accept any documents you show them that are proof. They can't demand to see different ones. Your green card is on list A, but you can produce one document from list B (including lisence) and one from list C (including unrestricted SS card) instead. That's what 99% of US citizens do.

Also, a direct quote from another question:

1. Do I need to reverify lawful permanent residents who produce a "green card" with a future expiration date?

No. Lawful permanent residents who produce an unexpired Permanent Resident Card (Form I-551 or "green card") should not be reverified, even if the Form I-551 lists a future expiration date.

And this outreach brochure (http://www.usdoj.gov/crt/osc/pdf/en_wbroc.pdf) has a case just like yours (employee fired for not showing proof of extension of green card).

That said ... I guess it depends how your employer is likely to react and how much you like your job. :unsure:

Yes, an unrestricted card means all it has is your name and number, without a restrictive legend (Social Security's name for the thing that says "VALID FOR WORK ONLY WITH DHS AUTHORIZATION"or "NOT VALID FOR EMPLOYMENT"). If you got it after your green card, then it's probably unrestricted.

That website I linked to has numbers that you and your boss can call on their "Contact Us" page. Maybe all he needs is to call someone at that office and talk to them about what's required for you?

If you used your green card to show proof of eligibility, my reading is that he's not supposed to ask you for anything at all because he doesn't need to reverify when the green card expires. But I could be mis-reading.
