Hi

I'm on OPT working as a medical resident and I got married to my husband last year NYE who is also a medical resident. We both graduated in May last year and I'm doing a paid residency which is not much, but my husband isn't getting paid and he actually is paying tuition off of his student loans. We got a letter from USCIS with four checklist (all marked) basically saying

1. The petitioner/sponsor lists their current income on Form I-864 as an amount to be considered as sufficient; however, no evidence has been submitted as proof of income.

2. Based on the documents submitted Form I-864 for the petitioner/sponsor the income did not meet 125% of the federal poverty line for the petitioner/sponsor's house hold size. Submit evidence of assets that meet the standard listed below or obtain joint sponsor.

3. The petitioner/sponsor's household member lists their current income on Form I-864 as an amount to be considered as sufficient; however, no evidence has been submitted as proof of income.

4. Based on the documents submitted Form I-864 for petitioner/sponsor and the household member(s), the income did not meet 125% of the federal poverty line for the petitioner/sponsor's house hold size. Submit evidence of assets that meet the standard listed below or obtain joint sponsor.

Basically, it sounds like both of us have to show our proof of income. Here are my questions:

1) Does each individual income have to be 125% or more of the poverty level or our combined income?

2) Does my husband's student loan counts as income?

3) Also, I do make money, but it isn't a lot either. Would it be better to do joint sponsorship with my father-in-law to increase our chance or would it further complicate the process? What are the forms/evidences does my father-in-law have to show to qualify for the joint sponsor?
