That is mean (middle of the AOS process) was out of law or by lawful (legal) ?

Pending. It means PENDING.

Your status was "I-485 pending", or "pending adjustment of status" or any way you want to word it.

It is a legal immigration status but it means you were not a permanent resident.

Timeline:

2005-04-14: met online

2005-09-03: met in person

2007-02-26: filed for K-1

2007-03-19: K-1 approved

2007-06-11: K-1 in hand

2007-07-03: arrived in USA

2007-07-21: got married, yay!

2007-07-28: applied for green card

2008-02-19: conditional green card in hand

2010-01-05: applied for removal of conditions

2010-06-14: 10-year green card in hand

2013-11-19: applied for US citizenship

2014-02-10: became a US citizen

2014-02-22: applied for US passport

2014-03-14: received US passport

No-one is going to tell you you were a Permanent Resident before getting the Green Card, because is not the case.

People here are truly trying to help you.

There are a lot of things that are the same for Green Card holders and US Citizens. Maybe you can tell us why you think you need to apply for citizenship, because it might be something that does not require it (but obviously we don't know what it is).

Again, people here, trying to help you, nothing else.

I understand why you are upset. You did everything right in your process. You came on a K-1 and you married within 90 days and you applied for Adjustment of Status just like you should have. Unfortunately, you were unlucky. The USCIS took a very, very long time to approve your Adjustment of Status. It's not fair that you will have to wait until Nov 2016 to file for your citizenship, but unfortunately it is the truth. I know you are frustrated, and I would be too.

You have never been illegal here. When you are in between a K1 and a green card, there is no name for the status. It is just waiting for AOS, and it is legal.

As for your question about during AOS pending, your status was:

USCIS considers a person with a pending adjustment of status application to be in a period of authorized stay as granted by the Attorney General. This was stated in a policy memorandum by USCIS on June 17, 1997:

"Aliens with properly filed applications for adjustment of status under both sections 245(a) and 245(i) of the Act will be considered aliens present in the United States under a period of stay authorized by the Attorney General."

Then i was lagel to stay in USA and live my wife. My marrige was lagal too. Then after my 3 years marriage, i can apply for N-400 , then i was lagal perment resident without card. ( because USCIS was very busy or lazy not me.)

I cannot apply on Dec/2014

because For N-400 they need one more tax return after green card (2014) + 3 years tax return 2011-2012-2013. Then i will apply on feb /2015

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

 

September 26th 2016: I-751 package sent to CSC

September 28th 2016: Package delivered
September 30th 2016: Check cashed
October 3rd 2016: NOA1 received with receipt date of 09/28/16
November 3rd 2016: Biometrics received with appointment date of 11/14/16.
November 14th 2016: Attended biometrics appointment
October 30th 2017: Infopass appointment to get I-551 stamp
February 26th 2018: I-751 case number (aka the NOA1 receipt number) becomes trackable
March 14th 2018: Submitted service request due to being outside of processing time.

March 15th 2018: ROC approved. 535 days (1 year, 5 months and 17 days)

March 29th 2018: Card being produced

April 4th 2018: Card mailed out

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.

That is exactly it. You were NOT a legal permanent resident. Your status was "AOS pending". Not out of status, but not a LPR, either.
