Hi all
I am not sure my post is right place or no, if it is wrong place sorry about that.
But this is very important to know, when i can apply for my US citizenship.
Those are about my stutaion.
Please Help!

I came in USA by k-1 visa on " Sep , 2011"

Also i married with my fiance, On "Nov /2011"

My I-797 Adjustment of Status approval was on Dec 15 /2011

My conditional green card never issued.

My 10 years green card arrive on" feb /2014"

Can I fill out N-400 forms on Dec 20, 2015?

(it will be 3 years +1 days or more days after my 1-797 date)

8.1)...When can I apply for United States citizenship?
A...As a spouse of a US Citizen, you can apply for citizenship 3 (three) years after approval of your Adjustment of Status. Your approval may be noted via any of the following: approval notice (I-797), on your passport (I-551 stamp and date), your green card ("resident since" date). The 3 year countdown begins with that date. This 3 year period does not include long absences from the United States.

If married and living with a US citizen in a bona fide marital relationship, you can file ninety days before the three year anniversary of the "Resident Since" date on your green card.

Why was the conditional green card not issued?

it seems that you made a mistake when you mentioned the approval notice was 12-2011. I think that was your initial notice ( Acceptance of filling). both of the notices are I797 but one for the initial filling and one for the approval. it seems you didn't go over the ROC because at the time of your AOS approval you were married for more than 2 years. So, if you look at your GC you will have a resident since date which determine your eligibility for citizenship [ 3 years - 90 days of that date]. if my assumption is right then you will be eligible for Citizenship around December 2016

the good thing that you don't need to do ROC but your counter toward the citizenship just started sad.png

I was going over your Timeline and I think you are missunderstaning the ROC;

if @ the time of your AOS APPROVAL you were married for more than 2 years USCIS will give you 10 years GC and you won't need to do ROC.

if @ the time of your AOS approval you were married for less than 2 years then uscis will give you a conditional GC ( 2 years) and you HAVE to do ROC

I didn't filled for ROC,

Because I hadn't green card. The day I put on the timeline for ROC,is the day we called the congress lady and....

Yes, we are still married also she is a 100 % US citizen, more than 250 years her family are living in USA

After married on NOV/2011

I sent the r I-485 form and .... and they sent me

recieved number and they took the money i sent to them, $1070

my I-485 notice that USCIS sent for me the Date is Dec/2011

On the 2012-10-10

AOS transfer to california, for "Decision"

But There was like black hole , nothing arrived to me from there about what happend for "Decisoon"

Also we called more than 16 time each 45 day to see what is going on my I-485 , but right answer never came to us.

Just They said we are working hard. .....wait wait wait.

In end on11-11-2013, we sent the congress lady a letter by email and talked with her in person, she did good job and USCIS sent my file to our state and after interview and showing some picture from our marriage and something we have to share ... during 10 mintues, officer siad your green card will arrive after 2 weeks. The GC arrived almost 8 days after interview.

So what's the "residence since" date on your green card ? Please post those 6 digits, everything else is entirely irrelevant. If you got your green card in 2013, you'll be able to file for citizenship in 2016.

I'm not saying the VJ guide is good or bad, but I trust official resources (i.e. the USCIS website) above anything else.

What is the "resident since" date on your green card? Please look at your green card and share that date, if you don't mind.

It doesn't matter when you received your 10-year green card, if your adjustment of status from your K-1 visa was approved in December 2011, your green card should reflect that.

Addendum to my earlier post: after reading the details above (you should have shared all that sooner!), I think there is some confusion somewhere. So like I said, the "resident since" date on your green card is the determining factor.

2005-09-03: met in person

2007-02-26: filed for K-1

2007-03-19: K-1 approved

2007-06-11: K-1 in hand

2007-07-03: arrived in USA

2007-07-21: got married, yay!

2007-07-28: applied for green card

2008-02-19: conditional green card in hand

2010-01-05: applied for removal of conditions

2010-06-14: 10-year green card in hand

2013-11-19: applied for US citizenship

2014-02-10: became a US citizen

2014-02-22: applied for US passport

2014-03-14: received US passport
