Hi VJ,

It has been quite a while since I have been on here I kind of took a break and couldn't file because I lost my job 6 months ago but I am anxious to file this week with our taxes. We have been married almost 2 years...my husband came to the US 7 years ago on a tourist visa and never left. We met 3 years ago and we are just now able to file please give me a refresher on what documents I should file for him to be legal. Also I dont think I meet requirements for affidavit of support and I will have to use my mom as a co signer will it be a problem that she is retired on a fixed income?

You'll file an i130 and also the papers you need for an adjustment of status. (I485 I think) I believe the overstay will be forgiven.

I recommend you consult with an attorney before you file. The fact remains that your husband violated the terms of his original visa;

The USCIS and if not, later, the embassy that grants you the visa, may assume he got mattied to only stay in this country. This can lead to delays.

At least a brief consutlation with an attorney is warranted for your own good.

As far as the affidavit of support, the fact that your mom's on a fixed income shouldn't matter as long as it's fixed above the 125% threshold.

If he's been there for 7 years then one would assume he's had some form of employment during that time.

Illegal work is forgiven for a spouse of a USC but what form of work would he have been doing?

If it was simple 'paid under the table in cash' kind of work then you should be fine.

If however he has at any point claimed to be a USC himself to get a job or used someone elses identity then that would complicate things and a quick chat with Mr Lawyer might be a good idea.

August 2000: We start e-mailing. I'm in Bosnia, she's in Florida

October 29th 2000: She sends me e-mail asking if I would marry her

October 29th 2000(5 seconds later): I say yes

November 2000: She sends me tickets to Orlando for when I get back

December 6th 2000: Return from Bos

December 11th 2000: Fly to Orlando, she meets me at airport

December 22nd 2000: I fly back to UK

January 3rd 2001: She flies to UK (Good times)

Mid February 2001: Pregnancy test Positive

Mid February 2001: She flies back to US

March 2001: Miscarriage, I fly to US on first flight I can get

May 2001: I leave US before my 90 days are up

June 2001: I fly back to US, stopped at airport for questioning as I had only just left

September 2001: Pregnancy test Positive again

September 2001: She falls sick, I make decision to stay to look after her as I am afraid I may have problems getting back in.

April 16th 2002: Our son is born, we start getting stuff together for his passport

March 6th 2003: We leave US for UK as family

Early April 2003: Family troubles make her return to US, I ask Embassy in London about possibilities of returning to US

April 16th 2003: London Embassy informs me that I will be banned from the Visa Waiver Program for 10 years, my little boys first birthday

June 13th 2006: I-129f sent

August 11th 2006: NOA1 Recieved

After our relationship breaks down she admits to me that she had never bothered to start the application process
