Getting a SSN if the K1 Visa expired.

Hello,

So the whole problem that we have it is because of taxes purposes (let me explain you). I came to the US in October and got married in November, our lawyer sent us in January the list of documents that we need to have in order to start the AOS. it took us a month to get all she asked us to do, my wife asked a month before we met up with the lawyer if we needed to file for taxes and the lawyer said no.The day we went to her office the lawyer asked us to file taxes before we send everything in, we filed taxes jointly and we realized that I needed a SSN to file taxes which our lawyer didn't asked for because she wanted to do it once I get my Green Card, basically we decided to request an ITIN which can be use instead of the SSN. My wife filed for taxes but the option that they asked for my SSN we left it in blank and we wrote that we were getting an ITIN. For the ITIN we sent a print copy of my passport notarized and my National ID card to IRS and yesterday we got on the mail a notice that I need to send my passport which we dont want to do because changes are that it can get lost in transit.

Is it possible to get my SSN even if the I-94 already expired almost 3 months ago? According to our lawyer she sent our documents to USCIS two weeks ago, we already have our tracking number to see the status of the AOS on the USCIS website.

Did you also apply for your EAD? This is your best bet right now, since you will most likely get your EAD before your GC. As far as I know you can only apply for a SSN if you either have the I-94, which in your case is unfortunatly too late, since it has expired, a work permit (EAD), or a GC. But it can never hurt to just go to the SS-office and see what they say. ;) Bring the old I-94, passport, your NOA1 from AOS (if you have it yet) and just have a go at it.

By the way... the US Postal System does not lose mail. You are used to Tico Correo Postal so I don't blame you for the hesitation.rofl.gif I have had 1 mailed item lost in over 25 ears of using the Postal ystem. I sent a Christmas card (no money) once to CR and my fiance never received it. They don't have real addresses so I can see why it's difficult to deliver mail.

I think you may now need to wait until the greencard to get a SSN. Some dumb SSA employees do not want to accept a EAD card, you can ask for a supervisor but many of them are pretty dumb too.

File for an extension which gives you until October to file your taxes. Just make certain you pay any amount owed or are expecting a refund otherwise you will owe a penalty and interest. I do not understand why people who have issues with the SSN and the like do not use this little item established by the IRS. You need a SSN in order to file taxes, but must wait on the USCIS in order to get that SSN. So give yourself more time. I would include the extension filing in with your AOS package. If asked why you need more time to file you can simple state that since you did not get the SSN before the I-94 expired, you have to wait on the USCIS to give you an acceptable document that the SSA and its poorly trained workers will accept.

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
