AOS doubts

I wasn't being rude at all, we actually talked and we are in the same situation. I was explaining her that our husbands can file different things. What... I am not sure.

Arianna, there isn't anything special can an active service member file for his/her foreign spouse. You have to go through the procedure as everyone else. Some other benefits you may be qualified include expedite EAD or Interview basing on Military deployment, free Medical exam, and free JAG consultation. However besides these, you have to wait and file all the same document as everyone else. Gather your husband's last year W2, Tax return, employment proof, and all the other necessary document. It's all on the guidance.

My husband is active duty in the Navy, he wants to know exactly what he needs for the AOS package.

W2? 3 years of tax returns? LES? (how many months?)

The important thing to send in your AoS packet is a copy of his orders, so they know that if they select you for interview, he will not be able to attend. I highlighted my husband's anticipated return date so it was obvious when he would be available.

You would still need to present the same documents as everyone else. Military has a lower/different poverty guidelines. I would bring tax transcripts, they are easy to obtain, it doesn't matter if you werent the one who filed taxes, you can print them through irs.gov, you just need your ssn. Also, orders or LES statements would be good, we even had a letter from the CO then to say he belonged to this unit etc for proof of employment. I don't think that was necessary though. The military hotline is also helpful.


a POA would also be super helpful for you when he does leave (if you are unable to reach him). When my husband deployed we had limited contact as well. I had to use the POA for a couple of things, like for calling our car insurance, returning a leased car, getting a rental, looking for an apartment etc.

My Journey:

We met through a study-abroad program in Shanghai, China in August of 2009

We got engaged March of 2010

I received my K1 VISA in 6 months (June-December 2010)

We were married 04/02/2011
I received my conditional 2-year greencard (AOS) in 2.5 months with no interview (April-June 2011)

Our son was born 02/03/2013

I received my masters degree in Speech-Language Pathology 04/17/2013

I received my 10-year greencard (ROC) in 3 months with no interview (March-June 2013)

My husband returned from deployment 06/20/2013

My naturalization journey took 4 months (April-August 2014)

I became a US citizen on 08/01/2014

Received passport in 3 weeks (regular processing)

Thank you messybrownhair, I think I got everything.

Hmm, the 1040 and w2 will suffice.

POA is Power of Attorney. If you plan to live in the US during the deployment, it will come in handy. It's also good proof. Unless your name is already in everything.. :)
