My husband is active duty in the Navy, he wants to know exactly what he needs for the AOS package.

W2? 3 years of tax returns? LES? (how many months?)

Anything else?

Oh okay. My husband is currently deployed and I have to send the same type of documents as everyone else. Well except his tax returns because he's exempt from filing until he returns.

If you find out other wise please let me know. I've yet to reach that stage so I'd be interested to know so I don't mess anything up

As soon as your case reaches NVC I suggest you expedite there as well so you can get AS MUCH DONE before your husband leaves. This would make things soooo much easier on you.

We filed our petition a few days after my husband deployed and it's been crazy. Since he was the only one that could speak to USCIS he would call, request to expedite, check on our case etc all of this happening and I wouldn't find out till days later because we hardly got to talk. The time he could spend talking to me he'd have to sit on the phone with USCIS for an hour waiting to speak to them.

Our case is slowly making it's way to NVC and he keeps calling to see if our case is there yet and then updates me 2-3 days later. I hope you don't have to go through this

I don't get to talk to my husband while deployed, maybe some e-mails but there is no Skype or Facetime or anything.

Why can't you call NVC? I don't understand. I use some App on my phone and I called a couple of times USCIS as well. My husband is very busy with pre deployment things and if it wasn't for me we were still sendind the I-130 to USCIS.

Did you get your NVC Case number? If your husband has internet he can do everything online, not sure about sending the AOS package. I'm having my husband sending that to me before the end of the week and I'll send it to them. I also got my hubby's bank's routing number and everything to pay the fees.

Wow that's gotta be tough for you. We email a lot so we try to have these very thorough visa discussions over email haha we work with what we got.

I can call NVC but since we're going to try an expedite it there as well we thought it's best he calls NVC so that as soon as he finds out our case has arrived then he can immediately put in a request to expedite as opposed to me finding out our case has arrived then asking them about the expedite process then letting my husband know 2-3 days later when we finally talk. It's basically just a time saving thing. I'm surprised you got through to USCIS because I read here so many times that USCIS will not even talk to a beneficiary hence why I didn't bother.

We haven't got the number from NVC yet. As far as I know our case hasn't even reached NVC because Texas felt like unnecessarily holding on to our case for another 3 weeks after approval before sending it out. I have all my husband's details to pay fees. At the moment my main concern is actually getting my case to NVC because it's been over a month and nothing!!

Hi, I think as a service member and member's spouse, you still have to provide all the document following the guidance. However, you should be able to get free advice from JAG, and don't worry about the interview even if you husband is going on deployment. Most officers are nice to the military, they will not give you a hard time. I went to the interview by myself because my husband could not get a leave, and I was approved in five minutes with very little questions asked.

You will need to provide his official order of being deployed, and his LES for last year, his 2013 W2, his birth certificate, yours, and the relationship proof such as mutual auto, health and life insurance, pictures, lease contract and something like facebook interaction.

Good luck!

So he doesn't need 3 years of tax transcripts but only his 2013 W2, am I getting this right?

He doesn't file his own taxes, we have somebody who does it for us so he is a little lost here.LOL,. And also a bit lazy. But his W2 has all his taxes info so it should be fine.

thanks, deployments sucks but at least next time he'll come home, I'll be there waiting,

no one said you were too lazy to read, he merely showed you the guides in case you weren't aware they existed. Being rude to people who are trying to help isn't very cool.

Arianna, there isn't anything special can an active service member file for his/her foreign spouse. You have to go through the procedure as everyone else. Some other benefits you may be qualified include expedite EAD or Interview basing on Military deployment, free Medical exam, and free JAG consultation. However besides these, you have to wait and file all the same document as everyone else. Gather your husband's last year W2, Tax return, employment proof, and all the other necessary document. It's all on the guidance.
