Hi guys,

I have been searching information about this question but i have not found the answer. Do you know if a child under 18 years old must live in the USA to keep their legal residence?

March 26, 2009: We become a couple!
September 10, 2009: Arrived for first meeting in-person!
June 17, 2010: Arrived for second in-person meeting and start of travel together to other areas of China!
June 21, 2010: Engaged!!!
September 1, 2010: Switched course from K1 to CR-1
December 8, 2010: Wedding date set; it will be on February 18, 2011!
February 9, 2011: Depart for China
February 11, 2011: Registered for marriage in Wuhan, officially married!!!
February 18, 2011: Wedding ceremony in Shiyan!!!
April 22, 2011: Mailed I-130 to Chicago

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

I would also like to know the answer, as well as to a related question if I may extend the original question - which is whether there are the same residence or other requirements for minors who automatically become US citizens when their parents naturalize, as there are for the parents. For example, if a minor hasn't met all the residence requirements but the parent has, do they still get this automatically? (Example here such as child having been out the US for longer than 6 months at some point but the parent having met all continuous residency requirements.) I assume the child has to be resident in the US to get automatic citizenship too?

To the best of my knowledge raising an immigrant stepdaughter, residency requirements are the same as an adult. In particular if you surpass the age of 18 before your mom gains her US citizenship. N-400 requires that you meet the residency requirements.

And if you stay out of the country for longer than a year, will have problems with your green card. But not sure on this, stepdaughter was only gone for a month.

Feel to be on the safe side, if you want to stay here, should follow the adult laws on this subject.

Felt bad about bringing a 14 year old here, separated from the only life she knew and was not her choice, but her mother's. So when she turned 18, could finally travel to her home country without fear of her biological father giving his permission to return if she wanted to. So I got her a plane ticket, her mom and I questioned if she would even want to come back, but this time it was her choice.

Ha, after two weeks, she was more than willing to come home, but said stick it out for two more weeks, would cost a fortune to change her plane ticket. Had peace after this, this time, it was her choice, went on to college and is now very successful and happy.

Sure you have your reasons for wanting to go back.
