- Iam living with my dad, and i make less then 125% of poverty guideline, so my dad's gonna be the joint sponsor. since he's a household member, should he should file a I-864 and he should file a I-864A, he claims my mom and my younger brother as his dependent?

also my sister is ready to be a joint sponsor too we live together on the same address but file taxes independently so should she file i-864 or i864A too??helpsmilie.gif helpsmilie.gif

Does the father meet the requirement for his household size of 4, himself, his wife, his dependent child and the intending immigrant? If so then he fills out his own separate I-864, and his wife can fill out an I-864A to go along with his I-864. If the father meets the requirement, then the sister would not be needed. You can only have one joint sponsor for one intending immigrant.

If your sister makes enough for her household size, herself and the intending immigrant? Then she could fill out an I-864 as your joint sponsor instead of the father. If she does not meet it on her own but your income combined with hers will meet it, then she could fill out an I-864A to go along with your I-864 as a qualifying household member. You have a few choices. Choose the one that works best for your family. I would choose the way where the income comes out the highest.

No. I assume they file taxes jointly though? Have him include his most recent IRS tax transcript and a copy of his W-2 to show it is all his individual income. He can use a letter from his employer and/or recent pay stubs to prove his current annual income, and he needs to provide proof of being a US citizen or permanent resident.

You are a permanent resident filing for your husband under an F-2A category, correct? The intending immigrant's income can only be used if the income source will continue after becoming a permanent resident. You must provide proof that it will.
