Hello everyone,

I have few doubts so please help me with it.

i-130; PD : 22 Oct 2013 ; case in Vermont Service centre (VSC)

1) My spouse is in USA and we applied in F2A category in the month of Oct 2013. We have not received approval yet and its already been 140 days, so we are quite close to the mentioned processing time i.e. 5 months. Now my wife will take Oath on 19th March and she ll be US Citizen then. Now problem is if i get dont get approval before her oath, should I upgrade my petition with USCIS or not? Will it affect the processing time for approval as for USC it takes more time to get approval.

2) Now if i get approval before her oath, then my case will be on the way to NVC. So how much time it ll take, for my case to reach NVC? In the mean time, my case will be no where, neither in USCIS nor in NVC...so how to upgrade petition in this case?

please help me with it.

I think that either way, you'll want to wait until it gets to NVC to upgrade... You're right, as of right now, it's still taking longer for spouses of USCs to get approval. And from approval, it takes the same amount of time to get to NVC... Seems like 2-4 weeks. As soon as your case hits NVC, (or as soon as she gets citizenship after that ) contact them to upgrade you to spouse of citizen. Good luck!

Hello everyone...

My wife is US Citizen now and I am still waiting for approval of i-130 from USCIS, so should I upgrade my case with the USCIS?

I hope by doing so, my processing does not lengthen as for USC it takes more than 5 months and for F2A category it takes around 5 months.

Please share your experience...

Also guide me regarding upgrading the case with USCIS...How to do it?

Hello eveyone,

My hubby filed a petition for me under f2a category. Our pd is January 3,2014. It was approved last february 24,2014 from CSC. NVC received our petition last March 5,2014. We have already my case number and INvoice id number. Its been 6 months thats my petition is still in NVC. Now my hubby is now a us citizen he got his certificate of naturalization. He will send a letter by tomorrow to NVC to upgrade his petition to me from f2a to IR enclosed with copy of naturalization and copy of NOA2. I wish it will fast the processing of my paper. Goodluck to us!

Thank you so much for wishing me luck! We had already sent the request letter for upgrading the petition. NVC told us wait for 30 days and atleast two weeks. And when we followed up them by call they told us to wait atleast now in 60 days. :( i wish it will upgrade soon. I really miss my hubby.

Hi Hardik,

No the processing time will be the same , however , your petition is not subject to visa quota under IR category which mean you will be able to get interview as soon as case completed. Basically there are no waiting times as opposed to F category which Priority Dates play an important role , you will have to wait till your PD become current to get interview even your case is completed.

Hi Hardik,

In my case it actually got faster...once I got upgraded, my case was approved even before those who had PD earlier than me. It may also depend on which is ur service center... I would suggest better change it with USCIS, because nvc may take some time upgrading your case and eventually delays...so better do it as soon as u get naturalization certificate... Good luck

hi everyone, I was naturalized today and immediately I sent off a copy of the certificate to NVC to upgrade my husband's petition. I'll be following this thread to hear about others experiences.

Glad to hear that , your case jsut like mine completed since March and still waiting and waiting

Hopefully as soon as they receive the upgrade , your husband will get interview as early as Nov .

Thanks Philip, I sure hope NVC reviews our packet quickly and that my husband can immigrate before the end of the year. I see on the NVC thread that NVC is taking up to 60 business days to review documents. Per UPS, they received the package at 10am this morning so the countdown is on :)

Hi.

I upgrade my petition from F2A to Ir 1 and NVC scan my upgrade letter on August 11, 2014, and i called many times to NVC and they told me to wait for 60 days to upgrade my visa category from F2A to IR 1. so i have another 1 more day to complete 60 days............ Also i want to know for further process will it take 60 days for each and every document.

MY PD is October 29, 2013.

Can anyone tell me the meaning of scan date? Also meaning under review?
