I was married to an Us Citizen from Oct 2007 to June 2012 (4.5 years) and been a green card holder and permanent resident since 05/21/09. I remarried an Us Citizen in May 2013. Can I file for Citizenship yet or do I need to wait for the 5 year lapse comming May.? Since the N400 form says you can file if you've been married for 3 years.

You were not married to the same US citizen for the whole three years. However id your resident since date on your green card says 05/21/09 the you can file for citizenship based on five years as of right now. USCIS gives you a window of 90 days before your 5th anniversary, which you are in it already. So you can go ahead and apply now.

You can only file based on 3 years of marriage to US citizen if you're still married to and living with the same USC. But, you can apply 90 days before your 5 year permanent residence anniversary (90 days prior to 5/21/2014, so that is actually right now..

However id your resident since date on your green card says 05/21/09 the you can file for citizenship based on five years as of right now. USCIS gives you a window of 90 days before your 5th anniversary, which you are in it already. So you can go ahead and apply now.
