Just before NOA2 on I-129F... Do I do file I-134 or I-864?

Hello kind internet people,

I had a question about my I-129F petition... My wife being currently in the UK is going to be assigned an interview as soon as the NOA2 arrives... At that interview should I get the I-134 or the I-864 for her to bring with her? She'll be going to the London embassy when the time comes...

The reason I'm wondering what to do is because I can make the 100% of poverty level with household size, but I can't make 125%. So I'm getting my dad to be a joint sponsor...

Anyone have the best way to approach this??

Are they actually going to be interviewing her for a K3? Are you sure? You'll be the first I'll have seen in London doing that since I've been on here.

An IR/CR-1 interview would require the I-864, the K3 I assume the I-134. However, even if it *is* a K3 interview, you'll need the I-864 for her adjustment of status once she lands in the USA.

It's more likely that you'll get the NOA2 for both the I-129f and I-130 around about the same time, so you'll actually probably end up with a IR/CR-1 interview, thus needing the I-864.

Either way I would have your Dad as the joint sponsor to be honest. If you'll need him for the I-864 you should use him for the I-134 if you end up with a K3 interview. The K3 generally take as long to get and even if you do get it faster, it's twice as much money. Since you don't make a lot to begin with, perhaps saving some by going the CR1 route might be ideal. That means an immediate green card for your spouse and she can start working right away. :)


Lost at Sea - I have a VERY strong suspicion that the USCIS is holding onto the I-130 and sending the I-129F ahead so that the NVC has to process it before they get to the I-130. It's their way of ensuring the K3 which puts more money in the hands of the USCIS (and less in the hands of the petitioner and beneficiary AND the NVC.)
