I think you might be out of luck for visiting as well... Have you tried yet for a b2? How long in the past are we talking for these issues?

the last one was 2009. the first one 2002... ai had 3 times problems with drugs and i was arrround 4 years in prison.

Hey. I know people do things that are stupid and regret them later. I don't know anything about you, except for what you've told us. For all I know, you might still be around drugs, guns, etc. I'm not here to judge though.

Based on what you've told us, I'm not sure if there is anything you can do to gain legal entry to the U.S. It's a sad thing, because of your kids, but these things happen - sometimes, parents get deported even and kids are left to stay. I understand, you'd like to be able to at least visit your kids time to time, but the way things are, the only way - at least for time being, is to have them come to you during summers and/or holidays.

Meanwhile, I would suggest to discuss your case with a different lawyer and contact that lady, that someone has mentioned to you about. It doesn't look promising, but it's worth a try.

He did 4 years, must be dealing.

He did 4 years, must be dealing.

Whatever he did time for, is irrelevant. What matters is the fact he was convicted of a crime, which falls into many categories mentioned in the guideline for ineligibility (I provided that link).

It is very relevant, possession vs dealing is a major factor.

My DIY opinion...

good lawyer + 10-20 MORE years of no trouble + US spouse and Child in good standing and huge advocates for you= 5% chance of waiver approval.

If he was dealing that is a crime of moral turpitude, there is a 0% chance if a waiver, not now, not 200 years from now.

I'm sorry, but you're wrong. It is irrelevant. You ought to familiarize yourself with the guidelines I provided the link to.

Whether it was just a possession, possession with intent to distribute, this guy was still convicted and incarcerated for 4 years. If he got that much, he must have been convicted of a felony - which is enough to make him ineligible to procure any type of U.S. visa.

First off, I hope that you got yourself straightened out and out of that element... Now regarding immigration, I have to be honest, not good at all... Those are so e big issues and recent ones... At this time, I would try to make arrangements for your spouse and child to come over to you. It is unfortunate she cannot live over there, as it is unlikely you will ever be able to come to the USA again... You might also,try www.immigrate2us.net to get other opinions as that site has a lot more who,are familiar with waivers and they can get you names of lawyers that won't BS you about the situation and just take your money... Good luck

I have seen people with felonies get waivers, depends.

I have never seen a drug dealer get a waiver.

He spent 4 years in an Austrian jail, I have a feeling those exceptions will not apply.
