I'm the US citizen in our relationship and the wife....because of professional reasons I opted not to change my name. We have only just recently filed my husbands I-485,I-765,and I- 131.

...in this day in age I would think that we've evolved enough as a country that taking your husbands name is no indication of a legitimate and valid marriage.

We are in the process of AOS from F-1. We just got married and we are discussing whether or not my USC wife will keep/change er maiden name to my last name. If she changes to my last name, how will the process go? If she keeps her maiden name, will that be considered a problem by USCIS? Thanks

You mentioned your wife is the USC. I am assuming that you are the beneficiary filing AOS from F1. Name change questions here are usually directed towards a non-USC wife asking about how changing names will affect forms. Since you do not have that problem I doubt it will be an issue when you file AOS. Changing names really is a matter of preference. If you both decide that she change her name to yours then go ahead and do it and file her forms using her changed last name. USCIS will not take it against you if she keeps her name though and it is not evidence of a genuine relationship.

Sein oder Nichtsein, das ist heir die Frage.
