Hello,

I married my wife who is Canadian in early 2013 earlier this year or I-130 got approved. I did my taxes in January and filed "single" because the tax agent recommended I do to get the money faster how ever since I was married I'm sure I would have had to file " married filing separetly" she plugged in her computer and both returns were the same amount. So she wrote a note on their as to why she filed "single".

My question is during the interview how do i know that when the CO sees that my return for 2013 is "single" will this be grounds for rejecting my case?

Beneficiary - Applying for CR1/IR1 (but also played the K3 card prior to understanding it may be phased out.)

2013: July 20: I-130 sent (Chicago lockbox)

July 24: I-130 NOA1

July 24: I-129F sent (Dallas Lockbox)

Aug 2: I-129F NOA1

Aug 12: Alien Registration Number was changed, I-129F.

2014: Jan 28/29/30: - 3 transfer notices for I-130 and I-129F.

Feb 3 - Hard copy arrived -Notice of transfer to Texas stating Jan 29th.

Feb 10 - NOA2

Feb 27 - email stating I-130 being sent to NVC from TSC.

March 6 -NVC received our case.

April 7 - CASE NUMBER yay! IIN and BIN obtained and email given.

April 9 - DS261 available and filled in online.

April 9 - AOS not yet payable but visible.

April 10 - email regarding NVC case number and access to DS261 received/ email regarding AOS received and paid.

April 11 - AOS sent by snail mail.

April 14 - AOS arrived per mail tracking.

April 15 - IV bill received via email, IV bill paid/ in process, IV package sent.

April 18 - IV bill showing paid/ DS-260 available and done!

- AOS scanned into their system.

April 21 - IV package arrived per mail tracking.

April 24 - IV scanned into their system.

May 2 - False checklist for IV documents= AOS approval.

May 13 - NVC rep reported ? missing Police certificate via my phone call.

- Supervisor review initiated.

May 14 - Checklist for Police certificate came via email.

- Sent checklisted documentation priority post!

May 15 - Package delivered per mail tracking.

May 19 - Case COMPLETE!! Police certificate found by NVC:)

May 28 - Case complete email arrived.

May 30 - Assigned Interview date!

June 2 - Interview letter arrived via email.

June 11- Medical appointment Surrey, BC

July 8 - Interview in Montreal!! APPROVED!!!!!!!! July 10 - Visa package and passport in hand!! July 23 - POE!!

I have looked at it but there's 73 damn pages of comments and theirs no clarification, she only suggest it will be a red flag. I find it hard to believe that they will reject my case after all the money I spent and the evidence i provide, it's not their the IRS. Its going to a consulate in Montreal.

I still need more clarification

Hi! If your marriage was on or before Decemeber 30, 2013 then you file SINGLE for the federal income tax return of 2013. See IRS form 1040 page6 (if I remember it right)

You have your marriage certificate during the interview. That will show them your marriage date and that will tell them if your civil status in your tax return is right.

Hi! If your marriage was on or before Decemeber 30, 2013 then you file SINGLE for the federal income tax return of 2013. See IRS form 1040 page6 (if I remember it right)

You have your marriage certificate during the interview. That will show them your marriage date and that will tell them if your civil status in your tax return is right.

My marriage did place before December 30, 2013 however I did look at the instructions page 6 to be exact and I was not able to validate what your information

If your marriage took place on 2013 then your federal income tax return of 2013 should have a MARRIED status.

Going back to your question that if this will make them deny the VISA, the answer would be NO. But there is a possibility that they will make you acquire a valid tax return with the appropriate civil status. You have to declare that you are married because your civil status is One of the things that the consular checks first.

-- I apologize for the wrong page number. Maybe the one that I have is outdAted IRS 1040 form instructions.

Check on the tax forum. There might be other members with the same problem.

We were told that to file as single is perfectly fine, as there is no legal or possible way to file married without having beneficiary's SSN or ITIN number.


January 2011 - Fell in love while both volunteering on a hospital ship. wub.png

I just had my taxes done in Canada a week ago. Was married Jan 11, 2013, so I explained my situation of being stuck in Canada during the immigration process since Apr 08, 2013. Last year the same people did my taxes and re-checked the tax laws again this year. They told me that I file as "Separated", because as of the end of the tax year being Dec 31st, I was actually separated from my spouse as we reside in different countries. They told me if I filed as "Single", for tax purposes, it will show to immigration I have intent to dissolve the marriage. Call someone at a tax centre & ask. If you filed wrong any tax place (ie.H&R Block), can am end it properly in 5 mins and give you a print out for your records for immigration. Don't panic, it can be fixed if its wrong very easy.

Well I don't know if Canadian Tax law is the exact same as American, I'm not the one immigrating my wife is. I went to H+R block yesterday for them to amend it, took over an hour and they gave me the forms to mail myself. So I think I will just keep a copy of that and if they ask in the interview then well have that as a backup.
