We got a RFE asking for evidence for I-864

Yes, so happy our case is worked on even though its not approve yet, but we got RFE instead so here is my question they are asking me to provide them this:

Based on the documents submitted with form I-864, Affidavit of support your sponsor's income did not meet the 125% of federal poverty line for your sponsor's household.

submit evidence of assets that meet the standards such as:

current letter of employment and 2013 W-2,

2013 federal tax returns ( if filed available)

bank statments covering the last 12 months or a statement from an officer of the bank or other financial instituition in which your sponsor has

deposits, including deposits/withdrawal history for the last 12 months and current balance..

When i sent in my aplication it was April 2013 and i started my full time permanent job in Nov 2012 im so glad now that i am above poverty guideline as i have worked one full year last year making it 23,000 which is enough. I just mailed my paper income tax today so i wont be getting that in for a while but i have w2. My question is should i wait for my income tax to be complete first to send them a copy with w2s and paystubs? Or ya'll think its ok to send in w2 along with emplyer letter and paystubs with an cover letter explaining to them that im still in the process of doing my 2013 income tax and its not yet availlable? whis is a better route?

You can send a copy of your 1040 with a copy of your W2 along with the employment letter and pay stubs, if you had have included the employment letter and pay stubs initially then you wouldn't have got the RFE.

I have a question about the annual income. The annual income is based on after tax?

No, annual income is based on Gross annual.

Mail them a copy of what you mailed to the IRS for 2013, since you said you mailed in a paper return. Then include the letter from employer and recent pay stubs. That should prove you meet the requirement and satisfy the RFE.

Current annual income is not what you made in the last year though(unless self-employed). It is what you currently earn annually. They may have sent the RFE because you had worked less than 6 months when you sent in your I-864 and they wanted more evidence that you in fact do meet the income requirement.

You can download the Tax transcripts here - http://www.irs.gov/Individuals/Get-Transcript printing those is exactly what the IRS would send you in the mail.

If you didn't make a copy of it, then the other option is to get the tax return transcript. However, since you just filed you may need to wait for the IRS to process your return. Sending just the W2 won't do anything, they will need the complete tax information.

You filled it out by hand and not on the computer and have no copy of what you sent at all? How long until your RFE is due back? Tax transcript is not usually available until after the IRS has processed your refund/payment. If you have time to wait for the IRS transcript, then you should. Your most recent filing is now 2013, since you did in fact already file. However, if you do not have time to wait, then I suppose that makes it unavailable and the first line of the RFE states the 2013 W-2 and new employment letter would be acceptable in that case.

yep stupid on my part i only did copies of the w2 but not the 1040ez form will i guess ill just send in the other stuff without the tax form than if they give problem than ill just wait it out for second rfe or something..
