Will I need a Co-sponsor?

Hi everyone,

We are currently still waiting for NOA2 but I want to be prepared for when the time comes to send all my income information to my fiance. I am the US citizen and he lives in Toronto, Canada so our case will go to the US embassy in Montreal. I have a 6 year old daughter so my income has to cover a household of 3.

From simply googling, I see the 100% poverty level would be $19530.00 and 125% would be $24413.00.

My income from my 2013 tax return is $27525.00. My concern is that my guaranteed income is only $24844.80 but I work overtime quite often so I end up making more at the end of the year. Will my employer only be able to say on their letter the amount of income that I am guaranteed? I will also submit my paystubs that will show that I am working more than 40 hours most weeks. I guess I'm not sure what exactly my employer should state in the letter. I also have $3500 in savings (most likely will have more before interview time) and I own a vehicle that lists on Kelly Blue Book for $2000.00 in the worst of conditions even though its not, I went with the lowest number. Do either of these count towards income?

Also, I receive child support from my ex husband. He is supposed to pay $50 per week but he got several months behind last year and was ordered to pay $75 a week to get caught up which is now taken directly from his paycheck. Would this also count towards income? I do not receive any confirmation of this, but can show the direct deposits that go in to my bank account each week, but like I said..it is not always consistent.

My sister and my best friend have offered to co-sponsor if we need it, but I would rather not have to ask either one of them to do that. Is what I have on my own good enough?

Thank you. Yikes, if my guaranteed income is the only deciding factor then it is very close for the 125%.

Am I correct that I only need to meet 100% on the I-134 for the interview part and will need to meet 125% for the I-864 at the AOS part and would just need a backup cosponsor if needed at AOS time?

yes it is true the i-134 require only 100% poverty guidline but sometimes the co officer at the embassy require the the income to be 125% of the poverty based on the fact that u will fill for aos very soon when he arrives to the usa so will need income of 125% so its actually up to the co officer to dicide if its fine or not so to be on the safe side u need to be over the 125%. from what i see that ur income is already the 125% so i think it will be fine if you want to feel more relaxe about it add any assets u have or any money in bank provide it and it should work and u wont need co-sponsor but if you do not have any assets or money in bank just go by ur income as long as it meets the 125% poverty guideline. another advice be prepared to find co-sponsor that will fill also papers with u in case co-sponsor ask for joint sponsor and let him have it as extra proofs with him in interview in case he is asked for joint-sponsor be ready now better than be ready at time of interview so u want be put under AP. and good luck

As long as "close" meets (or exceeds) the 125% guideline all is good.
