if i am reading your post correctly, it sounds like the lawyer has not even began to work on your petition yet. I would get the money back and file the petition yourselves. we sent ours in on December 9th, and have the interview on march 11th. There are many people on this site, and so much information that it is easy to do. I am so sorry that you have been waiting so long.

thank you for your help and your answer I am totally lost my finace contact a lawyer and he told him as always there are a lot of people must wait or it will send a request to the gouverment ask a for followed in our case but we must pay 100 dollar but again I say to my fiance no do not give any more money to this lawyer Because we have the right to a free track
my fiance say he will wait one month or two if not it will ask the lawyer to return our money or the half o money
I propose to my fiance to file the petition by ourselves but he asked my youhe tell me is to risk not fill the form with the correct information and it will return our file with a refusal and he also read that much people refuse ther file because they did not write the correcte information and also my fiance works 12 hours in day he did not have much time to deal with it

There is little risk in filling forms out himself.

If your fiance would read the guidelines here on VJ

http://www.visajourney.com/forums/index.php?autocom=custom&page=k1guide

http://www.visajourney.com/content/guides

and everything is filled out truthfully where is the risk?

He is the USC? He reads and writes English?

There is no way a case has been refused because people did not right the correct information. You and your fiance have the "correct information". If You and your fiance have met at least once in the last two years. And you can provide proof it is a real relationship then he needs to understand HE is choosing to wait and PAY for a lawyer to file, BUT does not have to.

He is choosing to add few more months to the (at least year) wait for you two to be together in the U.S.

On the other hand...IF your case is a difficult one, He just might be doing the right thing.

BTW you wrote he doesn't have time to deal with it cuz he works 12 hour days....

Maybe you can educate yourself on VJ and work WITH him on the process? You already searched and found this great site. We went through (or still going through) the processes ourselves and are here to help if we can...but you need to have your husband in agreement with you first.

On a side note he sounds stubborn and doesn't seem to listen to your advice or opinions on this subject....could be a continuous problem in your future. I wish you luck with the journey.rose.gif

To add to what my fellow countrymen and women said. You can also tell him to find an organization that can help him with that for free, if am not mistaken he's in Miami so lots of spinach big community big resources. Ditch the lawyer. For crying out lowed his Moroccan = smart.

are sure your fiancé is telling you the truth? (I'm not accusing anybody here, I'm just asking questions).

Filing the petition does not take that long, if you have all the necessary paperwork and the correct fees, the lawyer will not delay your petition (the lawyer has no benefit in delaying you).

Ask your fiancé if the lawyer started the petition and has a case number with USCIS for your I-129F (K1 visa).

The process takes about 5 months from USCIS receiving the petition to adjudicating it.

Being from Morocco (high risk country for fraud in visa petition) will delay the process for sure for couple more months.

BUT, just make sure you get the facts, and if you have a bona fide relationship, USCIS can only delay you and they cannot stop you.

Good luck
