Greetings...we're adjusting from K-1 and have all of the paperwork ready to send in our AOS package. We intend to file it this week. What we don't know about is do we need to include "evidence" of our marriage? We just got married two weeks ago and we have pictures from the ceremony where my wife's family and a bunch of our friends were present. We've so far had issues getting her added to my bank account (the bank won't allow her on my account until she has a U.S. ID).....I HAVE managed to get her added to one of the utility bills, but that bill won't show up for another month in the mail....we're not sure how else to show a co-mingling of assets. I have added her to my credit card, but again the bill only shows my name, she's just an authorized user and I don't know how else to document our relationship since we've only been married for so little time. Any thoughts? Or do we just send in the required forms, bc, marriage cert, passport photos, etc (everything listed in the AOS guide) and assume they'll ask for "evidence" at the interview???

Any info is appreciated. Thanks.

I adjusted from a B-1 so i'm not sure if the requirment of evidence is the same. I included photo's of our travels and Vacation we were on before we got married.Then photo's of us interacting while we were married, like functions parties etc The only evidence i had of joint accounts was a car that was in both ouyr names (because i had no credit score) and later Tax returns with both our income on. That's it.

My package (concurrent filing of I-130, I-485, I-765, and I-131) was sent yesterday via express mail and was received and signed by R Mercado today. Based on the information from this thread, I'm assuming I will receive a text/email in about 7 days.

However I have a concern: My wife's visa will expire on April 1st, or 5 days from now and she will be out of status. Some questions I have:

1. Is the day that you receive the text message the same day that the application is officially accepted?

2. Will my application be rejected if my wife's visa expires before they officially accept the case?

I'm really stressed out about this. I'm hoping the case is considered pending since they have received my package. If anyone can help with these questions, I would really appreciate it.

What type of visa your wife currently have? Actually, I think her overstay is non-issue at AOS, but she cannot leave the country until the AOS has been approved. You guys are fine!

you'll be fine cuz the visa expired means she's out of status which also means the visa is valid for 90 days to get married (ONLY). We can file AOS anytime we want not based on the visa expiration date, don't stressed out!

Hey everybody,

I just got our NOA1 hardcopies. No biometrics appointment yet. But the I-485 online status says that our fee was accepted on 3/18th vs our priority data of 3/13th. I thought that meant they were scheduling an appointment and I would recieve the details in a hardcopy notice as well. Guess I was wrong, so will be waiting.

Will keep you guys updated as to when we have the biometrics appointment scheduled.

cuz i think most of us in this thread came with K1 visa.

You are fine. No need to worry about her visa expiry. They won't reject your application even if they accept your application after your wife's visas expire. You got nothing to worry about.

February 28- AOS package sent. ( I-130, I-485, I-765)
March 5- Package delivered to USCIS Chicago.
March 11- Email and text notification with Receipt Numbers.
March 14- Hardcopy of NOA1 for all three applications.
March 21- Received biometrics appointment letter for 04/04/2014
April 2 - Completed Walk in Biometrics appointment successfully. (Original Appointment was for 4th April)
April 9- I-485 Case status has been updated to " Testing & Interview "
April 16- Text and email alert for case update for AOS interview on 22nd May 2014.
April 18- Hardcopy of Interview notice received in mail.
May 22- AOS interview, approved on the spot and got stamp in my passport.
May 27 - Approval notice of I-130 and I-485 in mail.
May 29- Received GC in mail.

No need to worry! I don't think she'll even be considered an overstay, but overstays are forgiven when you marry an US citizen! :)

Thanks guys! I feel much better now. I read that some people have overstayed their Visas for months to even years, and still were able to file for adjustment. So I should be good! :)

Sent in my AOS Package. Accepted and routed to National Benefits Center. Awaiting my Biometrics appointment in the mail. Excited that things are moving along. I am the immigrant and my wife is the USC. Good luck to all of us. I love having a place where all of us have something in common to discuss and share experiences.
