NEED HELP URGENTLY!!

I submitted forms i130 765 and 485 for myself as well as i130 for my son who lives in my home country. All my applications were accepted n notices received however my sons i130 was returned. The reason was:

"...because the eligibility you filed under requires that you file form i485. Please resubmit both forms to continue processing..."

I'm confused because i submitted form i485 which was already accepted. Can someone help me out!!!!

I am adjusting my status but my son is not since he does not live in the us. I submitted i485 for myself already.

I think , you will need to adjust your status first and after you are a permanent resident then you can petition for your son. At this point all you can do is to list your son name on the I-130 you fill out. You are not yet permanent resident to file a petition

It's my husband that is petioning for him as his step child. Which he is legally allowed to do since we are married before my son turned 18

Yes, send separate package for his application with I-130 and required documents and in form I-130 form, question 22, answer the part where it says "If your relative is not eligible for adjustment of status, he or she will apply for a visa abroad at the American Consular Post in, city and country.

I think you are absolutely correct. That's where I made the mistake. By putting his i130 petition with my AOS package. So should I do a new form or just resend as is, just stand alone.

I am not sure about question 22 part for sure, if your son is in his home country then you should write N/A, as the question states that Complete the information if your relative is in the US and will apply for adjustment of status. If your old form is fulfilled correctly then you should send that one otherwise Fill the new one and send it.

it also says if they are not eligible to adjust satus in us u can put country and city in grenada where your consulate is. its on the same line 22

Yes that's what I thought at 1st and that's why I said earlier write city and country where his consulate is.
