I-864 Part 6, Questions 13 and 14

Hi all,

This may seem silly, but question 13 actually doesn't make much sense to me. It has to sentences.

One:

"I have filed a Federal tax return for each of the three most recent years."

Two:

"I have attached...for ONLY THE MOST RECENT TAX YEAR."

Ok, so if I want to include 3 years, do I check the box in question 13? The first sentence, I should say yes to, because I have in fact filed taxes for the most recent three years. But the second sentence, which includes the words "only the most recent tax year" I cannot really say yes to, since I will be including 3 years.

Obviously I should check box 14 because that is about the transcripts for the second and third years. I'm just confused about this box 13. Is it just written poorly?

Final question: if a joint sponsor files their taxes jointly, the answer to question 13.a.1 should be:

1: Line 22 from 1040 (ie. "Total income" line from transcript) Note: this number actually includes the income of both filers, even though only one is the joint sponsor.

2. Something else. If you think this is the answer, please explain.

They are asking that you have filed in Q13. You asking you then attach the most recent year. Q14 is a statement saying you're sending the other tax trancripts or returns as well.

Include a w2 as well if both people file jointly but you only want to use one person's income.
