Replacement SS card denied

SS failed to send the SS card. They gave my wife a number, but now that her K1 has expired they say they won't give her a card until adjustment of status. Can they refuse to give her a card, when they have already given her a number?

In our state the SS card is required for drivers lisc. or state id.

How close to the expiry did you file for the SSN? she may well have to wait now until she gets her EAD or Greencard....

We filed for the SSN more than two months before her K1 expire date. They gave us receipts and even the SS# and for many weeks SS office kept saying it will show up or call back. The last time that we went to the SSN office, a few weeks after the expire date the clerk at the SS office looked at her I-94 and says she does not have status and a replacement card cannot be ordered until her status changes. The letter that they gave says it was denied because she is not available to work. I explained that we know she cannot work until she get the EAD, and that she has been issued the number, so it makes no sense to not give her a card. But no reasoning with bureacracy.

They are not allowed to issue the card if your wife is no longer work authorized.... she will need to wait until she has her EAD and then go and file for a replacement card... but at least you know she has a number...

Try a different SS office. I remember for some people worked.

I'm not surprised, they wouldn't even give my husband a SSN. And we applied well before his K1 was up. Now I find out he should have gotten one and it's biting us in the you-know-what. Good luck getting a replacement, and if they don't issue it....Here's hoping for a quick EAD approval. Best wishes!
