B2 for Vietnamese cousin

Hi hoping people who have been through similar can help. I've read the guide, a few threads and the government website but still feel i'm missing the inside track.

So situation my wife is a US citizen (naturalized 25+years ago) earlier this year we visited her family in Vietnam and really want one cousin to visit us.

The cousin:

  • Female in her 40s
  • 3 children in Vitenam 22,18 and 16
  • No formal higher education
  • Works very hard but all the work is Informal
  • Contributes to bills but likely not in her name
  • Traveled to China and Hong Kong before in good standing

On this basis how likely is it that she will get a B2 visa?

Is there anything she can do to increase her chances? Supporting documentation? Would it help if we gave her $$$ to put in her bank account?

I've also heard conflicting reports that we can sponsor her for her B2, by writing an invitation letter and giving her copies of our bank statement, the only thing I can see online for this seems to relate to people from India however http://www.path2usa.com/visitor-visa-guide/invitation-letter-for-visitor-visa

Pretty much we will do whatever it takes to get her to visit us, what can we do!

09 Feb 2012, Day 1 Package received at Chicago Lockbox

14 Feb 2012, Day 6 Email of acceptance, application being sent to NBC

15 Feb 2012, Day 7 $1070 check cashed.

16 Feb 2012, Day 8 $420 cheque cashed

27 Feb 2012, Day 19 Bio appointment letter received

02 Mar 2012, Day 22 RFE received

03 Mar 2012, Day 23 RFE returned with info

07 Mar 2012, Day 27 Acknowledgement of RFE returned - now waiting for their response

20 Mar 2012, Day 40 Did Biometrics - previously rejected for walk in bio @ Elizabeth, NJ and Manhattan

30 Mar 2012, Day 50 online status changed to inform me of interview on Mayis day 49

02 Apr 2012, Day 53 EAD & AP in production

It is not a chance based scenario except maybe at the margin. Her situation does not look that promising as described.

She applies and will find out one way or the other.

Based on what you posted, it's unlikely that she will get the visa. However, her only chance of getting one is to apply. People do get visas from Vietnam to visit the US.

There's nothing you can do to increase her chances. She was evaluated based on her circumstances.

You depositing money into your bank account will only backfire. First she needs to prove that she got the money from a legitimate source. Second the sources the US so that does not help with her ties to Vietnam. Sure looks shady and will be treated accordingly. The US is well aware of this trick of transferring money temporarily into someone's account when they're applying for a visa.

A visitor visa has nothing to do with you. Your accounts. Your invitation letter. Non-of that matters. None of this shows her ties to Vietnam. It shows her reason for staying in the US and overstaying her visa.

Why are you willing to "do whatever it takes" to get her a visitor visa? Why so desperate?

Ok maybe whatever it takes is hyperbole, but she was so friendly, helpful and wonderful when we visited that we want her to visit the US and see our home. We would be willing to spend many $$ and time to help her come.

We'll have her apply and see what happens.

There is nothing YOU can do that can help her, SHE has to prove her ties to Vietnam.

And remember, it's prove her ties in the OPINION of the Consular Officer.

There's no bit of paper or form that can 100% prove that she will return home so it's down to the sum of all the evidence she has and the way she puts herself across at the interview.

And looking at it from the outside, as the CO will be doing, there's a reasonable chance that having American relatives who are so motivated to have her visit may be seen as a negative, ie. you want her over so badly that you'll do anything to help her stay in the US illegally.

That probably hasn't crossed your mind but by law the CO must assume that she will stay.

August 2000: We start e-mailing. I'm in Bosnia, she's in Florida

October 29th 2000: She sends me e-mail asking if I would marry her

October 29th 2000(5 seconds later): I say yes

November 2000: She sends me tickets to Orlando for when I get back

December 6th 2000: Return from Bos

December 11th 2000: Fly to Orlando, she meets me at airport

December 22nd 2000: I fly back to UK

January 3rd 2001: She flies to UK (Good times)

Mid February 2001: Pregnancy test Positive

Mid February 2001: She flies back to US

March 2001: Miscarriage, I fly to US on first flight I can get

May 2001: I leave US before my 90 days are up

June 2001: I fly back to US, stopped at airport for questioning as I had only just left

September 2001: Pregnancy test Positive again

September 2001: She falls sick, I make decision to stay to look after her as I am afraid I may have problems getting back in.

April 16th 2002: Our son is born, we start getting stuff together for his passport

March 6th 2003: We leave US for UK as family

Early April 2003: Family troubles make her return to US, I ask Embassy in London about possibilities of returning to US

April 16th 2003: London Embassy informs me that I will be banned from the Visa Waiver Program for 10 years, my little boys first birthday

June 13th 2006: I-129f sent

August 11th 2006: NOA1 Recieved

After our relationship breaks down she admits to me that she had never bothered to start the application process
