Hello everyone,

Were in need of advice. In August we will be needing to Remove Conditions on the 2 year Green card.

Hany didnt begin working until June 2013

Also we didnt file previous years after he arrived because our income was below the requirement to have to file a tax return.

We went yesterday to try to have our taxes done and were told since I had no record of the cash I had earned and part of Hanys income required a 1099 form from his employer ( 8 weeks cash for 2013,only $850.00) We would owe self employment taxes and we would have to pay about $250.00. The tax lady said you arent required to file since you made under $10,000.00 and if you file you will owe. I sat there feeling lost and confused due to ROC coming this year for my husband.

I Dont know what to do!!

Question is, Are Tax Records needed when filing for ROC?

They most definitely asked for copies from IRS for taxes filed. They want to see how you filed, Married filed jointly or separately. If you didn't make enough money to file taxes then go to IRS.gov and look at the forms you can get to show you didn't need to file and what you can show as evidence.

HI, what is the update of this? We also have low income. Can you tell me what did you do in filing taxes?

After researching many VJ post. We have decided not to include tax forms with the I-751 when we file for Removal of Conditions in August. We will include a letter of explanation and all other evidence we have of our joint accounts and photos and anything else we can gather. I hope it all goes well because it's the best we can do. If anyone else has suggestions of other good evidence we can add please let me know. Thanks!

Honestly, they generally do expect taxes, whether filed jointly or separately. Every case is different and these officers do what they feel like doing, those who filed separately or did not file, and encountered no problems with USCIS, then you are one of the lucky ones. I think they are important, if you decide not to send in any taxes which you have indicated, then I would start gathering as much evidence as possible, start comingling everything, bills, bank accounts, EVERYTHING. You should also anticipate a RFE or who knows, you might get lucky and get approved within a few months.
