Hi everyone I have read many peoples posts on late filings of the I-751.. Just wanted to get input on our case.

So we have been married since Jan 2010, got married in Cebu. We had one child together in the Philippines, as soon as she was born I got her stuff filed for u.s citizenship 4 months later she got her birth aboard and passport, in 2011 my wife got approved for the CR1 visa we came to the States on OCT 26th 2011.

Wife was already 6 months pregnant again and she gave birth in Ohio to our 2nd daughter.

We got the green card about 2 months later,stayed in the states for a little more then a year then went back to the Philippines because ( I own a business their )

we stayed for about 6 months and came back no issues..

So we have been back since Dec 2012.

So her green card expired oct 26th 2013,

Last week I just filed her ROC 751 paperwork along with bank statement and joint tax return and with our daughters birth record that was born in Ohio.

I also included a late filing letter for the reason " not being a good one "

I was told by some visa agencies to make up a good excuse and hope for the best..

For me I could not lie, so I simply told the truth, said that it was 100% my fault, I simply got the month and year mixed up because her entry cr1 visa in her passport said expires march 2012, and for some reason last year when I glanced at the green card and her passport I was thinking March of 2014 is when it expires thinking we had 3 years not two.

I did say that I know that is not a excuse for me not getting the expire date wrong and just asked for them to understand and that I was very sorry and please do not punish my wife as we have two young children that need their mother.

Anyone ever been in a similar late filing like this? and or any advice from anyone?

Whats the chances of getting denied or her being sent back?

I am just worried any info will help...

I would skip to the conclusion/last posts on the 2nd page to save yourself the headache and anxiety. (there are some pesimistic comments earlier in the thread that may cause more worry than you need right now)

Short story is filing ROC late is not the complete and utter catastrophe that you might be imagining right now.

Of course I can't guarantee the outcome of your case..

But if your case is otherwise straigthforward and you have strong evidence documenting the validity of your marriage, then I think you have a good chance.

I'm not an IO, but I were one, I would personally appreciate the honesty and that you did not make up some lie to explain being late.

Approval or RFE is 6+ months down the road, but they ACCEPTED it for now, meaning they are going to process it, so that's a good sign. You can expect your NOA1 in the mail, this will be the 1-year extension. A couple of weeks after that you'll get the letter for the fingerprint appointment.

Hopefully everything goes ok.. From what I have read on recent timelines for CA service center is is only about 3 months from start to finish ...

So hopefully its not 6 months

Yes, I do think that's a good sign. Getting the NOA/extension letter is a better sign. Biometrics appoinment letter will be an even better sign.. one step at a time.

My ROC took a very long time, just take a peek at my timeline in my signature.

Here's hoping your wait wont be nearly as long!!

I sent mine to Vermont service center. I think back then VSC was slower than CSC. Maybe that's true now too!

What service center?

Vermont. None of the November filers here on VJ got approval or RFE yet, so I'm not stressing. And I had the bio appointment 2 months ago at the end of December.

We got the biometrics appt letter 2 days ago and is set for the 28th this month.. so far so good, hopefully were not in trouble.
