Hello all!

My wife move to the US in April. We were married in May. We've filed our adjustment of status (i765,i485). She was approved to work. We received a letter about a week ago stating that based off our submitted documentation that we'll qualify to have our interview waived.

My question is, until my wife's green card is approved, what is her official US status? Fiancé visas expire after 90 days so hers has been expired since July. What would she be classified as? She's not a US citizen yet so I was just wondering what we'd list her current status as?

Consulate : Manila, Philippines

I-129F Sent : 2012-07-18

I-129F NOA1 : 2012-08-03

I-129F NOA2 : 2013-02-21

NVC Received : 2013-03-08

NVC Left : 2013-03-08

She is "technically out of status" but she would be a citizen of which ever country she is from. I'm not sure where you need to list her status at all? Unless travelling, which I don't think you applied for an AP. Either way, i wouldn't worry - she is not in any trouble, you married witihn 90 days which is the only requirement within the time frame.

Her current status is pending approval of conditional permanent residency. She is legal here while pending approval and once the green card is approved she will be an LPR (lawful permanent resident). If you want proof of her legal status, use the NOA1 from your I-485 application.
