My head is spinning trying to get this scenario to make sense. Sounds like this man wanted to marry before his divorce was final. He knew the divorce wasn't final and lied about it too. Don't you think the USCIS will look at this with a lot more scrutiny? I would, that's for sure. I am just guessing, and this is just my opinion, but this first "marriage" might be cause for a delay, not necessarily a denial. Methinks your fiancé/husband made things a bit worse for your case. Like I said though...JMHO.

Geez, what a story....In my opinion since this is going to be a marriage based visa...The MARRIAGE part of this is very important, the fact that there was fraud concerning any marriages that you two had, is going to raise "red flags". GoodLuck.

Hello eveyone I'm just new in this site. I read some of the topic here and im sure its really help alot to get some idea and things what to do during the process of the visa..Well i have some problem year 2005 me and my husband met one of the website dating that time im having vaction here in Philippines i supposed to be back to abroad for worked but He really dont want me to go back there and he promise me that he will come here to marry me. I dont know about the marriage law cos i've neverbeen to anyone so we make a fast and bad desicion we got married 2005 while his divorced papers is not yet finalized.. In year 2006 we got married again and make the things right and our second marriage certicate my husband used for petitioning me...My question if incase the 1st marriage comes out during the interview it is possible that i can get denie? Please i need some advice in this matter thank you very much in advance....

I was watching a programme the other day that says the US has no central registry of marriages (only each state) and a lot of bigamy takes place without being discovered. Not that I am in favour of bigamy but it's amazing what the authorities can't check.... anyway this is just an aside - not encouragement - jeez two wives ? one is hard enough some times !

It's important to see things the way USCIS will see them, and that's from a legal perspective, not an emotional one. Put aside all your rationales about WHY you married someone who was already married. You are each culpable in this matter, not just him. Visa denial based on polygamy could be applied to either of you.

The best advice is to get several opinions from immigration attorneys. Do not pick one because he/she tells you what you want to hear. Weigh all evidence the way USCIS will, based strictly on facts. Do not weasle and try to absolve yourself because of good intentions or timelines. That's not how your case will be decided.

Fact is, he had an American wife and married someone else before his divorce was finalized. He married again later, but that may not be considered, since it was game over at bigamy. Please get professional advice and be prepared for the possibility of denial. We wish you good luck.

If you ask the wrong question, you'll get the wrong answer.

It's not a question about the validity of the first or second marriage to the current wife. It's about the attempt to have two marriages to two wives at the same time.

A polygamous marriage is, by definition, invalid (at least in the U.S.) The point is, it's also illegal, and cannot be brushed off with a friendly explanation (whatever that might be.)

Fact is, the man tried to have 2 marriages simultaneously, so the real question is: is he eligible given a polygamist past?

That is not polygamy. Go look up a detailed definition. You need to PRACTICE polygamy (be involved with 2 or more wives at the same time in a relationship). He would be considered a bigamist.
