Hello eveyone im just new in this site. I read some of the topic here and im sure its really help alot to get some idea and things what to do during the process of the visa..Well i have some problem year 2005 me and my husband met one of the website dating that time im having vaction here in Philippines i supposed to be back to abroad for worked but He really dont want me to go back there and he promise me that he will come here to marry me. I dont know about the marriage law cos i've neverbeen to anyone so we make a fast and bad desicion we got married 2005 while his divorced papers is not yet finalized.. In year 2006 we got married again and make the things right and our second marriage certicate my husband used for petitioning me...My question if incase the 1st marriage comes out during the interview it is possible that i can get denie? Please i need some advice in this matter thank you very much in advance....

Since he wasn't free to marry at the time of the first marriage, the first marriage is void (and he is a bigamist to boot)...

The second marriage is the only valid marriage, but the fact of the first one may bring questions about the validity of your marriage...

If asked about the first marriage then tell the truth.... that is all you can do... you say that your husband used the 2nd marriage to file for the K3 so you were legaly married at that time, so no problem... if you had been trying to use the first marriage (before his divorce) then you would have got denied as it was not a legal marriage...

Thank you very much Sir to your reply..so it means Sir it will really cause of denie even we tell to them our reason why we did that before? and is there any hope for that? i just want to be with my husband its really kind of difficult to be far away to each other...

The foreigner must go to their Embassy and provide their ID (I used my passport), birth certificate, and proof of any previous marriages being terminated to get an 'Affidavit of Capacity to Marry'. That document is needed for a foreigner to apply for a marriage license in the Philippines. The way I see it, if he wasn't divorced he wasn't free to marry so the original marriage in 2005 is invalid. My question is, how did you get a marriage license for the 2nd marriage in 2006? I thought marriages in the Philippines were automatically reported to the NSO. If that's the case, why didn't the original marriage show up during the application for the 2nd marriage license?

Hi...For the second time around we make everything right..my Husband went to the Embassy to get legal capacity and we waited for 10days then we got married for second time they registered again our Marriage certificate and the the 2nd certificate is certified by the NSO...

If it comes up in the interview or at any point during the process, be totally honest about it and the entire situation. I don't know if you will be denied for it or not. It is up to the consular officer to give the final word on that but again, just be honest about everything and good luck!

If it comes up in the interview or at any point during the process, be totally honest about it and the entire situation. I don't know if you will be denied for it or not. It is up to the consular officer to give the final word on that but again, just be honest about everything and good luck!

I still don't understand how you got married a 2nd time in the Philippines if you already had a previous marriage on record there. Didn't your husband have to get an Affidavit of Capacity to Marry the first time around? If so, wouldn't that show up when he applied for the 2nd one? Why wouldn't they ask for proof that marriage was terminated? Same with the NSO recording your original marriage and the 2nd one. There's no question that your marriage in 2005 was invalid because he wasn't free to marry but I don't understand how you could marry again without explaining the situation with the first.

Well i guess this is what the situation is.. when they got 1st married on year 2005 her husband was not yet divorced (obviously for this ground the marriage is technically void) and then they had their 2nd marriage 2006 where they already did the right process, with the right documents. NSO sure will not certify their first marriage hence it is void because of the existing marriage her husband has at year 2005. So the NSO did certified/authenticated their second marriage for the reason that it was done according to the law and no faulty was made during this time.

Shamar30, hence you used your 2nd marriage contract you have nothing else to worry about because it is valid and your 1st marriage (2005) was void technically. It will be best that during interview you husband will be with you and be honest to the consul. Being honest wont harm you, at least do your best that consul will understand positively the case.

Good luck and do a lot of prayers because it will help you.

Exactly true.. first marriage was null and void due to the validity of the prior marriage.

Thus the marriage was not legal therefor it was not recorded.. .. so hence the only valid marriage currently is the second one.. (in the eyes of the law) .

Think positive.. and if it is questioned.. it is that since it was not a valid marriage .. is why it was not said.. if that is the why... but just be honest with what is happening..

I see no reason why that would be a reason for denial... .. after all.. both times it was with the same person... .. wouldnt that show intent.. on the relationship?.. I think so..
