The problem is CO asked me to bring the IRS transcripts, I showed him his W2 but consulate wanted to see only the IRS transcripts

My husband is out of state, he got his W2 but has not filed it yet.

Please friends advise can we get his IRS transcripts even when he is out of states

You have already got correct advice on the tax issue. Here I am copying from the I-864 Instructions:

Ask your husband (petitioner) to submit the 2013 tax return immediately. After he has submitted the return print out the 'pdf' copy of the return with all the attachments. You can wait for the tax transcript but that may not be available at the IRS website for another 3, 4, or more weeks. But you do not need to wait for the tax transcript. The consulate will accept a copy of the 2013 tax return as it says in the instructions below.

Additionally, it is a very good idea to submit a letter from the employer, and also copies of last 6 months pay stubs.

"You must provide either an IRS transcript or a photocopy from your own records of your Federal individual income tax return for the most recent tax year. If you believe additional returns may help you to establish your ability to
maintain sufficient income, you may submit transcripts or photocopies of your Federal individual income tax returns for the three most recent years."

Thank you a lot for that information, as everybody here said i will wait couple weeks or month until transcripts will be available and I will bring to the consulate his IRS transcripts for 2013 with high amount

On my 221g they are asking IRS transcripts for 2012 not for 2013, so is that ok I print for 2012 and i get only W2 form for 2013?

NO. As I recall didn't you say that he did not make enough money in 2012 so that won't work. He needs to file his 2013 taxes NOW and get the transcripts to you ASAP!

You lknow I think the problem here is that your husband OWES taxes because if he was getting a refund why would he wiat until April 15? That just doesn't make sense to me. And you're right. A cheap lawyer is a cheap lawyer. There is a reason they don;t charge as much as other lawyers. It's because they suck, generally. The guy your husband hired is probably not even an immigration attorney. Not sure about what your husband is thinking but if I was you I'd be pretty pissed at him right now.

You are absolutely right, I called him today , I told exactly the same thing, This process is taking more than a year.. I explained him that CO wants to see only IRS transcripts.. They dont care that he has a time to file it until April 15

Tell your husband to file his taxes end of discussion. If he has any concerns he can always file an amendment. Otherwise you just have to wait. Good luck
