NVC stage F2A I864 tax questions

hey guys, i have my wifes case at NVC right now and i have a question about I864 affidavit of support and my taxes.

I am a student, and my wife is obviously not here i have filed for her to come here, she doesnt have a ssn or anything for me to claim her. so i have filed single for the past 3 years but once she gets here i will amend the taxes, will me filling single be an issue at NVC? i do have a joint sponsor but i just dont want anything sent back and want to make sure.

any one knows? i keep calling and asking them and they tell me its ok thats they are just looking at my earnings, again i just want to be sure.

Hi there! A lot of people here say you can't file taxes as single when you're actually married, even if your spouse is not living in the US because the CO can take that as a "red flag" on the interview date. But, I know someone from Colombia (here in VJ), he filed as single and his wife didn't have any issues at the interview. She got her CR1 approved. Apparently COs don't take that as a red flag because they know taxes can be amended once the alien spouse arrives to the US. My husband filed single as well an we're not concerned about that, they just want to make sure he makes enough money to sponsor me. If NVC told you it's ok, you shouldn't worry about it. Your wife will be fine.

yea i asked lawyers, acocuntants, etc and they all said it sgould be ok.

either way i will include a letter from a CPA expplaining why i filled single and my intentions when my wife is here with a ssn for us to amend.

thank you for your info its a relief sincerely.

did you guys get everything done or are you still waiting for a interview?

No problem! and yeah, a letter explaining the situation sounds good to me. We're not done with NVC at all, just got the case number this week, it took 37 calendar days from the day NVC received our case. We already submitted DS-261 and now we're waiting for the bills to be invoiced and send the packets, which are almost ready to go. I hope we can have case complete this month to get an interview in May. We'll see!
