Filling jointly tax returns, spouse overseas with SSN

HI,

I am trying to fill my tax returns and I am so confused that I don't know what to do.

I got married on Jan, 2013 and my wife came in USA on Feb, 2014.

She already received her SSN and now I'm trying to fill our jointly taxes.

I use Turbotax, but when I try to e-file the taxes it says that I have to mail them, because NY state have such kind of requirement, because my wife was not a resident during 2013.

So what I have to do, any advise?

Does anyone went through this?

July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

To clarify, you were married in JAN 2013?

Filing status (single, married) is determined by your status on 31 DEC 2013 for the 2013 tax filing.

The IRS allows a USC/LPR to treat a nonresident spouse as resident for the purposes of filing a tax return. Please read IRS Publication 519, the section entitled Nonresident Spouse Treated as a Resident. You will need to file a short declaration of making this choice, which is explained in the publication. Very easy to do.

We got married on Jan 03,2013

Now she is here and she has SSN, I used it to fill out the forms in Turbotax, but when I want to e-file the forms, the systems says that for NY I have to mail them.

So I am not sure, I have to mail the forms only for NY or I have to mail everything?

Sorry to say, but NY is just plain weird …

Determination of e-filing seems partly dependent on your adjusted gross income; even still, doesn't look like TurboTax is supported for e-filing in NY.

You could file federal electronically and NY by paper/mail. You'll probably need to print out copies of your federal return as some states allow you to use, for example, Federal 1040 Schedule A, in lieu of a state form, and attach it to the state return.
