Hi -

I have a question and not sure if it's been asked on this forum already. I recently got my visa interview to move to the States. My mother is a US citizen and filed for me under (unmarried child over 21) - I am 40. My 16 year old daughter is also on the original application. I was wondering if my eldest brother, who is also my mothers child can be added to the petition before the interview date?

logically each interview is connected to its own and (only its own) petition and whoever in sponsored on that petition (ONLY), so the interview will be for you and your daughter, both of you are on the petitions from the start, and both of you went through the USCIS I-130s, medical and bio and so on.

your brother should be on a new different petition and your mom should sponsor him on a new separate and different petition. Even if you can add him (just saying if) its so late now because you are in the interview stage and soon will be issued a visa should all go fine. how long is it gonna take for the immigration to process your brother,s petition and add it to yours in such short time involving USCIS, background check, medical, NVC process, embassy file transfer, and so on.

Your brother can not be added to your petition.

Your mother needs to file an I-130 for your brother. Your brother will wait 12 years for a visa.
