Need help with answering some K1 Petition Requirements and Questions

Firstly, any advice/guidance people can give me will be greatly appreciated and thank you in advance.

Hello,

I am Indian, and I have been here since 1992. I just got engaged last month. As such I am trying to file K1 Petition to bring my Fiance here to the US. What I want to do is file everything myself as I have done several different filings before from my Green Card to my Citizenship.

I have read several pieces of information both at the ***removed***, and this site, and compiled basic set of documents and want to confirm I have gathered all the items into the package. As I am little paranoid, I am submitting little extra information then normal. If questions come, I/my Fiance who is of course more smarter than me can easily answer.

Also, hopefully this thread helps others little more as I am not finding clear and concise information of everything that needs to be in the package.

1. I want to get a better understanding of the second lock box address they USCIS have provided.
1.1. USCIS; P.O. Box 660151, Dallas, TX 75266 - looks like any normal mail.
1.2. USCIS; Attn: I-129F; 2501 South State Highway 121 Business Suite 400; Lewisville, TX 75067 - says it for express and courier deliveries. I can understand courier, but what does the express mean? Is it standard USPS Express Mail or FedEx or UPS Only.

Below is what I am placing in the package excluding the cover letter. I have pasted literally everything cover letter TOC.

1. Enclosed payment in the amount of $1,130 (# ).
1.1. $340 for I-129F Filing, $200 for Medical Fee, $240 Visa Fee

2. I-129F ORIGINAL SUBMISSION
2.1. 34.a of the I-129F
2.2. Copy of my US Passport and Citizenship Certificate

3. Letter certifying intent to marry (My Name)

4. Letter certifying intent to marry (Fiance's Name)

5. Proof of having met in person in the past two years and ongoing relationship
5.1. My Travel History Document form British Airways Website
5.2. Betrothal Invitation,
5.3. Engagement Photos
5.4. Phone Records from Google Voice

6. G-1145 E-Notification

7. G-325A and passport style photo (My Name)

8. G-325A and passport style photo (Fiance's Name)

9. Form I-134, Affidavit of Support
9.1 Includes documents related to my bank balances, 401K savings etc.

What I am not including in the package. I want these to be filled by Fiance as she is creating the profile in our consulate. Even though I am not including these, the above payment I am sending includes the Medical Fee. Does this create any issues.

Hi!

at a first glance, a couple things:

You do not have to pay all that now, as far as I know. The first check for USCIS is for the amount of 340 dollars for the fee. The Medical exam fee you have to pay at the clinic when your fiancee goes to have her medical and the last fee (240 dollars) is for the embassy, not for USCIS directly. You do not have to send the affidavit of support yet!! That's for your embassy, not for USCIS. So no form I-134 or attachments in this package, save that for later (you might have to do it again since it'll have to be dated much closer to your interview date)

I-129F Sent: Dec 20th 2013

I-129F NOA1: Jan 3rd 2014 (notification received by e-mail and text message; hard copy received on Jan 10th)
I-129F NOA2: Jan 27th 2014 (notification through USCIS mailing list; hard copy received on Feb 3rd)
NVC Received: Feb 07th 2014 (verified through phone call; no notification received)
NVC Left: Feb 11th 2014 (CEAC status changed to "in transit"; called NVC to verify)
Processed at Consulate: Feb 20th 2014 (I sent the embassy an e-mail on Feb 18th and they replied Feb 21st saying that they had received my case the day before)
Package 3 received: Feb 21st 2014 (sent by embassy through e-mail attachment; it was a Word document; they usually send it through regular mail)
Package 3 sent: Feb 24th 2014 (received at the consulate Feb 25th; I know this because I sent a certified letter with online tracking)
Interview date: April 30th 2014 (notification received by e-mail on March 21st; hard copy received on March 26th)

You only need to send $340 right now. http://www.uscis.gov/i-129f

You would not at any time be filling out and filing an I-130, unless you were to get married prior to your fiancee coming here on the K-1.

Express Mail will typically get there the next day, has a tracking number, can request a signature confirmation, and is the more expensive way to send at around $20. FedEx and UPS would be courier deliveries, along with any local couriers there may be in Dallas. The PO Box would be for regular and Priority mail. Non-USPS delivery services cannot deliver to PO Boxes.

December 12th, 2013: Picked up marriage license.

You have made a good start, but I will try to help you understand better the process for the I-129F. First of all, the 1st address listed is where all postal mail goes, including express mail. The 2nd address is for delivery companies like FedEx or UPS, which need the physical address and cannot deliver to a PO Box.

About your I-129F petition:

  • You are only sending a fee of $340 for the I-129F petition. The other fees (medical and visa) are when your fiancée starts her visa application, which is AFTER approval of this I-129F petition. If you mail the petition with an incorrect fee, the entire petition will be returned to you.
  • For proof of your citizenship, you need to include a copy of ALL pages of your US passport OR a copy of your Naturalization certificate. You do not need both.
  • Your letters of intent must include an original signature
  • The proof you have listed of having met in the last 2 years is not sufficient, in fact it does not prove you have met. Your travel history document may be considered, but I see it as only secondary evidence. You will need to include primary evidence, such as passport stamps, boarding passes, receipts from hotels, restos, atms, etc. that put you and your fiancé in the same location. I believe what you have listed is at best secondary evidence.
  • Put your G-1145 E-notification at the top of your petition.
  • Form I-134 Affidavit of Support is not needed for this petition.
  • You can also include some proof of your relationship as well, but it is not required.

Your fiancée can not begin filing any forms or applying for her visa until the embassy receives the approved I-129F. Your fiancée, once eligible to apply for the visa, will fill out the forms and gather documents as required by the embassy. A couple notes:

  • The DS-156 and DS-156K have been replaced with the DS-160. Your fiancée cannot fill this out until she has the case number.
  • The I-693 is a form filled out by civil surgeons in the US prior to filing the adjustment of status. This form is only needed AFTER your fiancée is here in the US with you.
  • The I-130 is not needed at all.

Thanks to this snow storm, I didn't mail the papers today and what a luck. From what I read from all three comments, I only have to make very minor changes.

Yes and no.

Express Mail can be delivered to the PO Box same as any other USPS method, however if the OP sends it that way and is requesting signature confirmation, then it needs to be sent to the other address for couriers and delivery services, as there is no one to sign at a PO Box and the package will be returned to him without one if that option is selected.

Yes and no.

You can still send mail to a PO Box with signature confirmation. When the mail is delivered, a delivery notice will be left in the PO Box instead of the actual petition. Whoever picks up the mail at the PO Box will have to go to the counter and sign for it to pick it up.

I have sent a letter to a PO Box before with signature confirmation, and it has been delivered and signed for no problem.

The advice you have been given here is good. Just follow the K-1 guide here on VJ. What is listed in the guide is all that is required with the I-129F petition > http://www.visajourney.com/content/k1guide

After the I-129F petition is approved, then the foreign fiance(e) can apply for a K-1 visa at the consulate in their country. You can check to see if your consulate has the instructions/requirements online. That way you can know what will be needed later.

Hello all. Literally few minutes back I got 6 text messages from USCIS saying my petition has bee approved. It has been long grueling wait to get this moved to next step. I will keep my timeline up to date.
