How do you file for Divorce from overseas ?

Hi all

I have a problem, came from the UK on a k1 visa, got married on the 10.23.2010 in IL. but now had to realize that our marriage was not of two equal partners but more like master and slave. my wife decided to inform me on my last day of being legally in the US that she will not sign the removal of condition application. Therefore i had no choice but to leave the US on may own ( not being deported ) and now need to look for a divorce while i am back in the UK as my wife wants to prolong the divorce. I her own words she keeps anything what she is entitled to, even my personal jewellery. I now feel like I have been rolled over, but i just want a divorce as i feel like everything else is only material.

Can anyone give my some advice how to proceed, PLEASE.

how soon did you leave the house in the USA?

I ask, because state residency rules give you some wiggle room,

and it's the state residency rules that govern filing of divorce (where to file).

usually 90 to 120 days of wiggle room but it varies by state. I not know anything about IL...

I mention this, all in the hope that is possible for you to file in the USA, in the county where you formerly resided.

If only you had posted sooner... You would have been able to file for removal of conditions on your own.

Yep, he could have filed as divorced and filed for divorce here. But he may have wanted to return home to, or maybe had little choice economically.

Thank you for all for your response.

My conditional stay permit run out on the 4th of Oct 2013 and as i did not wanted to be deported I left on the 16 of Oct.2013 .

I know I could have just stayed somewhere else but i did not wanted to be illegal in the Country having to look over my shoulder for any law officer.

Don't get me wrong , I loved the States and was willing never to leave.

as my wife wanted for a joint bank account and her's and my pension went in it, i was left with no moneys and I left the States with my daughter paying from the UK for the flight ticket.

Incase something happens to me I don't want her to be able to file for bereavement benefit from the UK.I think she got enough out of me ( building a large enclosed sun deck, converting a garage into a dining room, a complete new bathroom...........)

That is why i need to file for divorce from the uk as soon as possible.
