When does one receive notice regarding interview, etc

Timeline

My wife had her biometrics appointment for AOS back in December. She is adjusting status from her K1 Visa. It has been 76 days since the biometric appointment. The VJ timeline shows the average timeframe between biometrics and interview as 84 days. When does notice typically arrive? i.e. a week, 2 weeks, a month before interview?

If there is no interview does the green card just arrive in the mail or should we be receiving something in the mail soon stating no interview needed, expect green card to arrive in the next xx days, etc.

If your interview is waived you will receive a letter letting you know. But don't stress yet, 76 days seem way too short for interview appointment. Right now there are people waiting for 6-12 months, depending on if you have a interview or not.

6-12 months seems like an awfully long time. She received her I-512 Advance Parole/Employment Authorization Card about a month ago. My sense is if there were any issues, they wouldn't have sent us this?

Kind of hoping she gets her greencard in March so we can travel out of the country. I know she can technically travel with this I-512, I've read here that it would be a bad idea since we waited a few years to apply for AOS. I.e. we married in the 90 day period required under the K-1 and waited a few years to do the AOS.

If your interview is waived you will receive a letter letting you know. But don't stress yet, 76 days seem way too short for interview appointment. Right now there are people waiting for 6-12 months, depending on if you have a interview or not.

It depends on where your case is, and like mentioned above if you have an interview or not. But if you haven't got any notice yet then there's no way she gets her greencard this month. Check the official uscis site and see what dates they are working on right now. That'll give you an idea.

there are service centers that currently work on May/june2013 applications. That's just an example, but you get the picture.. AOS is a rather long waiting process. Just use the AP for traveling. You will be fine. If they didn't want her to travel she wouldn't have got the AP

On Visa Journey Timelines it says they are processing cases received on Nov 2, 2013. I.e. 119 days from Notice to Interview. Our Notice Date was Nov 19, 2013 so I would assume if there was going to be an interview in the next 17 days we would have received something from them by now?

I typed in the I-485 receipt# on USCIS just now and it just says, "On November 19, 2013, your fingerprint fee was accepted and we have mailed you a notice describing how we will process your case. Your case is being processed at our NATIONAL BENEFITS CENTER location. You will be notified by mail when a decision is made, or if the office needs something from you."

So we went for Fingerprints as requested on Dec 16th and recd the AP card about 4-6 weeks ago... but it says nothing about the AOS. Haven't heard anything about the AOS.

Regarding what you wrote about "Just go ahead and travel, they wouldn't have given her AP if they don't want her to travel..."

I'm pretty sure that is false and I'm pretty sure that if my wife were to leave the US it would create a 10 yr ban as we waited 2-3 years before filing AOS, thus she was out of status for 2-3 years.

There's no real way of knowing when you might receive an interview notice, because it really does depend upon how busy your local office is. The timelines here on VJ are pretty unhelpful when it comes to AOS, because every single local office has WILDLY different wait times, PLUS you might be one of the many cases who sit at the national center, and never need an interview.

So to sum up: since you were a K-1, you won't necessarily need an interview. It's pretty random. If they decide not to interview you, eventually they will send you an "interview waiver" letter, but that could easily be 6 months from your NOA1 before you even get that (and up to another 6 months after the waiver letter before you actually get approved).

If you do get selected for an interview, your online case status should progress to "Testing and Interview" which means they've sent the case to your local office and they'll be eventually setting an interview date for you. But that date totally depends on your local office -- some, such as ours here in San Diego, are pretty speedy (we had our interview about 100 days after filing in November), but other offices such as Tampa, Atlanta, and others -- they wait 6 months or more for an interview. The VJ timelines can't deal with the wildly differing times depending on local office, so you'll need to check what other filers in your actual location have experienced, and even then, there's no guarantees at all.

So van1234essa is right that you can't go by the VJ timelines for AOS interviews.

However, van1234essa is definitely NOT right about your AP -- your prior overstay makes a HUGE difference and it's very dangerous to travel after that long of an overstay. In fact I'd say your AP is worthless really -- you're absolutely right that with that long of a prior overstay, you should NOT travel even with the AP card. CBP has every right (and they will, most likely) not allow you to return even with AP, if you've overstayed prior to filing AOS. So I would strongly advise no travel until you have green card in hand.

All you can do is wait, but at least you can get a job and start working -- your EAD is totally valid and you can move on with your life HERE, just not travel.

Brutal... Today we just got the "Interview Waiver letter," that says it could be up to 6 months. Does it really usually take that long? My wife's heart just dropped. She hasn't seen her family in 2 1/2 years. Stupid me for not doing the AOS paperwork right after we married. I really thought it would take 3-4 months from filing the I-485 and that's it. This is just a shocker. I thought I did my homework here and it was a 3-4 month timeline after submitting the I-485. Words can't even describe our disappointment. Does it always take 6 months for the folks that get the Interview Waiver Letter? Can we call them and request an interview?

This is incorrect. The USCIS will approve the AP for an adjustment applicant whether or not they have over 180 days of overstay or not. They put a travel warning right there in the I-131 instructions on page 5.

It does not always take the full 6 months. Some have gotten the letter and been approved not too long after. Not to be more of downer, but some have had to wait a long time when being approved without interview, so long they needed to renew their EAD.

I did my biometrics in late December, and just received my interview date last week - which is April 10th. They could also send you an "interview waiver" case which could mean your GC will take longer than if you have an interview...It's really a case by case basis if you ask me. Dependent on RFEs, and other things as well.

As far as just receiving a GC in the next few days, I wouldn't bank on that...Especially if you haven't received any updates such as interviewing and testing stage (which I am now in), or an interview waiver letter... You will get one of those before a GC is issued. And with an interview waiver case it can take up to a year for some people.
