What supporting documents to NVC for DS-260 (to avoid RFE)

Hi All,

I am a bit confused on the supporting documents what is listed on the site versus the confirmation I got from the NVC Call support team. I am ***ONLY*** petitioning for my wife and we have just completed the DS-260 Form.

The NVC Call Support team confirmed *twice* that I need to provide a copy of the petitioner documents *in addition* to the beneficiary (my wife) for proof of identify. This goes against what the web site says here where its applicable for IR5 & F4: http://travel.state....mit-to-nvc.html

This is what we are planning on sending to avoid any RFE:

Cover

=====

- Printout of the NVC Barcode page.

- Letter listing all items

Petitioner (Permanent Resident / Husband)

- Original Birth Certificate

- 2 x Passport photos (2x2")

- Color Photocopy of Valid Passport Biographic Data Page

Beneficiary (Spouse)

================================

- Original Birth Certificate

- 2 x Passport photos (2x2")

- Color Photocopy of Valid Passport Biographic Data Page

- Original Marriage Certificate
- Original Police Certificate w/ US Embassy's document requesting the Police department for the certificate
Not Sending:
- Military Records (no military involvement)
- Court & Prison Records (no criminal activity)
- Marriage Termination documents (no previous marriages)
- Deportation documents (no deportation documents)
- Adoption documentation (no children)
Are we in good shape to avoid RFE of any kind? If you, the community could share your experiences on 'out of the ordinary' requests from the NVC. We could preempt any issuing of an RFE.

At NVC, they're called Checklists, not RFEs since it's a different organization all together handling the information. Beyond that, you need to check consulate specific documents. Some consulates require 2 types of police clearance, or something else. You should ensure you're following those requirements as well.

Additionally, people who are petitioning from notoriously tough consulates also choose to add more relationship evidence at this point.

Finally, why send your original birth certificate? That's not a requirement. I only sent copies. My husband's birth certificate was a copy with a certified translation, and we ordered a certified copy of our marriage certificate. No point in chancing the fact that you might not get your originals back.

Beyond that, you need to check consulate specific documents. Some consulates require 2 types of police clearance, or something else. You should ensure you're following those requirements as well.

Finally, why send your original birth certificate? That's not a requirement. I only sent copies. My husband's birth certificate was a copy with a certified translation, and we ordered a certified copy of our marriage certificate. Not an issue of the police clearance. We already got that and it was only obtainable by going to the US consulate and getting a request letter issued by them so we have the specific requirement here.

The original being an official copy issued by the registry that have official stamps. I can always order/purchase more copies.

The NVC call support person clearly stated that they wont accept photocopies of the Birth Certificate for the petitioner (Which was sufficient by USCIS years ago for my greencard application).

The confusing part was that the NVC web site says the petitioner's birth certificate is only applicable in IR5/F4 cases yet the NVC call support person said that the case officers usually expect it in the supporting documents for F2A cases.

2) Form I-864, Affidavit of Support (Original + copy)

3)Petitioner's Permanent Resident Card (Copy + copy)

4) Petitioner's Employment Verification Letter ( Original + copy)

5) Petitioner's Recent Pay slips (copy + copy) up to 6 months.

6) Petitioner's 2012 federal Tax Returns ( copy + copy)

7) Petitioner's W-2 for 2012, 2011, 2010(copy + copy)

If applicable: Petitioner's Divorce Decree (Original + Copy)

Documents for the Beneficiary:-

1) NVC Barcode Page for Application for Immigrant visa and Alien Registration & proof of payment of fees (Original + copy)

The police clearance was only an example. Other consulates have different documents they require. I suppose my point was to ensure you checked your consulate's requirements on their website. But if you've already done that and gotten everything you need, you are fine.

Oh i have a question. I read somewhere in the forum that if you have a co-sponsor for AOS and it is the mother of the petitioner you need to send a copy of the birth certificate of the petitioner for proof of relationship. Do you have a co-sponsor? May be that is the reason why they need a copy of the birth certificate?

That wouldn't make sense. A co-sponsor is not required to be a relative and there's no need to prove anything about a co-sponsor except that they are a US citizen and they meet the income requirements.

Why did you send original + copy of everything to NVC? It doesn't state that anywhere on the web site.

"Photocopy Requirements

You and each family member immigrating with you must also submit to the NVC a photocopy of the original documents or certified copies of the documents.

Translation Requirements

All documents not written in English, or in the official language of the country in which application for a visa is being made, must be accompanied by certified translations and submitted to the NVC. The translation must include a statement signed by the translator stating that the:

  • Translation is accurate, and
  • Translator is competent to translate.

That is stating the photocopy requirements for items that requires a photocopy which is your biographic data passport page. It is just stating you need to photocopy the original document or certified copy. No where it states you must photocopy each original document you submit.

You are definitely fine.. I just hope the NVC officer doesnt overlook the original documents you submitted and reference the photocopies.

You are definitely fine.. I just hope the NVC officer doesnt overlook the original documents you submitted and reference the photocopies.

It is up to you to take it since you are going through the NVC process. We did send the docs to NVC and got it approved and also got our visa approved a month back. Goodluck to you!
