Hello Everyone,

If the divorced mom is a Resident alien and the step dad is a US Citizen and the biological dad of the Mom's children is a very mean, angry, envious, brutal, cold hearted $#@#$ that has completely abandoned the girls for the past 2 years plus.....what will happen when we get custody...which takes quite some time due to the patriach society Mexico still carries...and due to the Bio Dad having the passports and his personal "facebook stated goal" of destroying the girls life to get back at their mother for breaking free from his obsessive control he had over her....Can we ask them to speed up he process and get a yes due to them being 13 and 10 years old...they will be alone in Mexico. It is really crazy to think a dad would do this to his own blood....but he has...and continues to surprise us with his attitude.

The children need either the father's permission or a court order allowing them to immigrate.

The US will not make a determination that the father is unfit or issue visas to the children in violation of US and Mexican laws and deprive the father of his legal custody.

There is a court of competent jurisdiction - the Mexican court. You need the court order allowing the children to immigrate before the children can be issued visas.

Have the step father file ( assuming he became a step before they were 18 ) then at the same time start legal proceeding in Mexico to get permission to immigrate the children here. As stated the US will not let you take the children without the fathers or the courts permission to do so.

This will not be over quickly. You will not enjoy this.
