If the visitor(Beneficiary) has proofs to show the embassy that he'll return, then it's possible.

by proofs i mean...things like his/her work, responsibilities like holding positions in his home country like a head of a clan, owing properties like houses, cars lands, having a family that's looking up to him like Kids, having large business(es) he runs back home, etc etc.

Your chances of approval are very low, because you clearly have immigrant intent. That being said, if you have the money for the application it is worth a shot- a denial will not harm your spousal visa case

Many thanks. I know she will be lying if she did not return and this will cause a big problem for her I-130 approval. She has every intention to return and wait for her approval.

Our children have to be in California for their school by September. Does anyone have any idea that November 2013 filer will be able to finish the whole process by August!!! thank you all
