Greencard: advice needed

Hello friends,

I am new to this thread having read some useful information and thought it wise to share my story and seek advice.

I am from south africa and a gradute student on an F1 visa. I will finish my program in May 2015.My fiancee was born in the US but has never lived in the US. She lived in the UK but decided to come to SA to work. I met her two years ago while in SA, got engaged to her November 2013 and wish to get married to her in December 2014. She intends doing a masters degree here in the US after our marriage while I go for PhD after my masters program.Now my questions:

1.Do you think I'm eligible for greencard despite the fact that my wife to be has not lived in the US although she is a US citizen by birth?

2. What kind of paperwork do we have to present to begin the application?

3. Someone told me that our case is too complicated because my fiancee has never stayed in the US, thus making the whole thing almost impossible.

4. Kindly advice us on what to do?

I would be grateful if anyone can offer useful information on how to go about this. Thank you so much.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Ans. Yes you can apply for a green card but she has to live in the USA for you to be eligible.

2. What kind of paperwork do we have to present to begin the application?

Ans. Proof of her residence in the US, Marriage papers, hers and your birth certificate, I-130 petition, supporting documents and affidavit of support.

3. Someone told me that our case is too complicated because my fiancee has never stayed in the US, thus making the whole thing almost impossible.

Ans. Marriage visa is for family unification and if she does not live in the US, she cannot apply for you.

4. Kindly advice us on what to do?

Ans. Ask her to move back to the US. Establish her residence and file the paperwork.

I would be grateful if anyone can offer useful information on how to go about this. Thank you so much.

10th Nov, 2014 - Applications delivered and Receipt Date

14th Nov, 2014 - NOA1 Date

20th Nov, 2014 - Received NOA1 hard copies

29th Nov, 2014 - Letter for Biometrics Appointment. Appt date - 12/10/2014

1st Dec, 2014 - Walkin biometrics done

13th Dec, 2014 - RFE email followed by Hard Copy on 12/19/2014 for Marriage Certificate

20th Dec, 2014 - Mailed RFE response with certified Marriage License and Certificate

21st Feb, 2015 - Received notice of potential interview waiver by mail

2nd Mar, 2014 - email received for EAD approved

First she will need a US domicile.

1) Yes, your wife can still petition you even if she has never lived in the US (see caveat below).

2) After you marry, your wife should file an I-130 for you; expect this to take around a year to be approved.

3) Your wife will need to show that she intends to re-domicile in the US. This a complicated subject, so you should search around for "I-130 domicile" before filing.

4) Provided your wife can show she is making the US her domicile, simply marry and file an I-130.
