Dear Members.



need advice on issues with my wife's status change from conditional PR to permanent resident..



She came to USA first time on april 2013, our plan was that she will go back in less than six months to finish her studies in Bangladesh and come back in about 1 year. She went back on Jan 2014, we had push back the date for other reasons, she'll be back in march,2014 right before her PR card expires. I was not aware (which was stupid I admit) that we would have to file i-751 to remove the conditions on her residency status, or more clearly, I wasn't aware of the i-751 requirements such as having joint bank account, mortgage, insurance etc. Since we knew she'd go back soon I didn't even get health insurance for her from my job, and didn't pay attention about the other things in the list. I filed taxes jointly on 2012 and 2013 thought. other than that I don't have anything jointly. Not having much of the expected evidences, how much trouble I'm in do you think? please advise

You should consider getting up to speed on the ROC process, rather quickly. You were provided with information about the necessity of removing conditions of your wife's conditional Green Card (GC) with the original mailing that contained the card. Be sure to verify the actual expiration date on the conditional GC.

Okay. Not sure how you didn't know about this unless a lawyer did all the work for her IR1/CR1 and never mentioned about the whole process.

Also. 5)4 dates you mentioned here aren't adding up. I-751 is comes to picture on the second year after her arrival. You stated April 2013, is that a type or you still have one whole year to fix, father paperworks?

As she came here with a plan which was temporary and if you are applying now, I would say go with what yoiu have. I am guessing at least she has a valid SSN and some sort of photo iD (state id or drivers license) which shows same address as yours. If she received any mail (even from USCIS) with address that would be good along with photographs together. As you filed joint tax, get the tax transcripts from IRS which is free. By his will show her name and ssn along with yours. If you can find other docs that would be great.

People try to provide many other documents (not mandatory) to prove their marriage and avoid te interview process. This is just additional burden and takes additional time. That does not mean without them you can't submit. Go with what you have and face the interview accordingly. If you have your reasons on why she many not have a utility bill (specially if she doesn't work and if you never had bank account for her) you go with your answers.

Finally when it comes to USCIS there is no such thing as "certain"; hence no matter how much supporting docs you may provide, you can never be certain. As long as you have the must ones and whatever you have at that moment, go with it with honesty in your mind

However I am still puzzled that this fell through the crack :-) and you weren't ready.
