All the US airports I've been to you have to get your luggage first before going through immigration.

Interesting, all the ones I have been through are the opposite.

Interesting, all the ones I have been through are the opposite.

That has been my experience too....I have never been able to get luggage until after the fact.

Just out of curiosity, how would the IO know how many bags you've brought with you, assuming you go through the immigration section before collecting bags at the carousel and then go through customs. Is your checked luggage on their screens? That's the way it is at our airport anyway, perhaps it's a different set up in other airports? I've heard from a lot of people not to bring too much luggage & my bf is only bringing the one bag and a bike. Kind of a silly question but hearing stories from people who've been turned around and not let in for their visits, I was wondering at what point does luggage get taken into account?

They can ask, or they can ask you to show the stubs you get when you check in your bags. On occasion, they can send you to go get your bags before reporting to secondary (they hold your passport and paperwork).

Luggage Is after immigration... From our experience This is how it is done at ALT, MIA, CLT, EWR, DFW, ORD, JFK, BOS, MNP, IAD, MCO, LAX, HOU and DEN ... Dont know about other west airports...

To the OP, a 2 week visit one year after your last visit is not a use of the VWP nor should be a red flag... You should be fine, just answer truthfully and don't be nervous...

Thanks all! And sorry for bogarting this thread. I always get so nervous about all this! My boyfriend's coming to LAX where you pick up bags after immigration. I thought it was the case everywhere, but it looks like each airport has their own route.

05/14: We were married!!

06/04/14: Finally marriage license was recorded & we got a copy

06/05/14: AOS package mailed via Fed Ex overnight to USCIS Chicago Lockbox

06/06/14: (Day 00) Confirmation of delivery & receipt date recorded by USCIS

06/11/14: (Day 05) NOA 1 Hard copy of receipt received

06/13/14: (Day 07) Form I-797C received, Biometrics appointment scheduled for July 8

07/01/14: RFE for co-sponsor salary and tax info, which was already sent with original package. Resent a copy on 07/08/14.

07/08/14: (Day 32) Biometrics appt.

08/10/14: (Day 65) Noticed that USCIS status has changed from Initial Review to Testing & Interview!

08/21/14: (Day 76) Received EAD/AP in the mail!

09/25/14: (Day 111) Email notice with interview date set for OCT. 29!

10/29/14: (Day 145) Interview day - APPROVED!!!

09/21/16: Mailed in I-751 Removal of Conditions

10/14/16: Biometrics appointment

8/8/17: Mailed N-400 Naturalization Application

8/15/17: USCIS texted that they've received N-400

9/8/17: Scheduled for biometrics 

10/11/17: In Line to be Scheduled for N-400 Interview
6/23/18: N400 Interview (recommended for approval pending I751)

8/1/18: I751 Interview - approved

I know of no US Airport that allows that for International arrivals, I have flown into LAX and from memory he could not do that.

Hiya Queen Comely, I am flying out on the 16th Dec for 76 days. I went over in Oct for my boyfriend's sister's wedding with no issues whatsoever but am slightly concerned about the gap between visits (around 6 weeks)

I am fully prepared with evidence of job to come back to ( I have been given unpaid leave) , flat I lease, payslips, car in the UK, bank statement as well as credit cards etc should I get asked but just wondering what you actually said at POE for purpose of visit?? Did they ask who you were staying with? Did you answer boyfriend?

I have no intention of over staying and I HAVE to come back. Everything I own is here! I just want to spend some time with my boyfriend and do some site seeing etc.

Also to zoom_ what happened?? I read so many of these threads and no one ever updates as to what happened!

This an old thread and Queen Comley hasn't been on the board since July. You'll be better off starting a new thread.

How long was your previous stay for the wedding? If it was short, say a week or two, you should be ok to come back for the 76 days with the proof of ties you listed. Always tell the truth to POE Officers. If you're staying with your boyfriend, you should tell them that.

Sorry, I just reread that and realised I hadn't said. My previous visit was for 2 weeks. I returned on the 5th of Nov.

Yes, I had hoped I would be ok! My concerns were what to say re boyfriend etc. I guess that issue will only come up if they ask who I am staying with which would be an obvious question due to my length of stay.

My plans are to spend Christmas etc with friends and their families and to see some more of the east coast. I just had a brief taste in Oct as my time was taken up helping to set up my friend's wedding. I am a genuine tourist but just know me having a relationship with a USC could raise eyebrows. I guess plenty of people have intercontinental relationships but I do worry! Thanks for getting back to me :)

I should add I plan to say I am staying with my boyfriend but only if asked! I think that is the general rule. Always be honest but answer only what you are asked. Also thanks re the info about Queen Comely :)

He doesn't get vacation?

That's not so unusual, my husband didn't get vacation until he'd worked for his employer for a year, and even then all he gets is five days. Compared to the 5+ weeks I got in the UK, it made sense for the visits to be one-sided.

ROC from CR-1 visa (Green Card expiration date was Nov 24th 2016)

 

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

 

September 26th 2016: I-751 package sent to CSC

September 28th 2016: Package delivered
September 30th 2016: Check cashed
October 3rd 2016: NOA1 received with receipt date of 09/28/16
November 3rd 2016: Biometrics received with appointment date of 11/14/16.
November 14th 2016: Attended biometrics appointment
October 30th 2017: Infopass appointment to get I-551 stamp
February 26th 2018: I-751 case number (aka the NOA1 receipt number) becomes trackable
March 14th 2018: Submitted service request due to being outside of processing time.

March 15th 2018: ROC approved. 535 days (1 year, 5 months and 17 days)

March 29th 2018: Card being produced

April 4th 2018: Card mailed out

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.

Wow, I feel old at my job now. I remember now back when I started my job 10 years ago, I didn't get vacation for like a year.
