Hi everyone,

I actually have several questions and I hope you guys can help me!

I was issued a K1- visa which will expire on march 03/31/2014. I am flying to New York on march 25th. Then I was planning to apply for my ssn (wait about 2 weeks after entering the US) and then get married. Here's my question: After getting married and having all the other documents required for the AOS process - do I need to get my name changed on the SSN BEFORE I send out the documents for AOS?

The problem is I need to get my advance parole issued ASAP due to some unfinished business in my home country (later more) and I don't want to wait the additional time to get the new ssn with my married name on it ( although I know it's only taking up to 10 days) but I simply don't want to risk it and not get the ap in time.

Second: the unfinished business I was referring to is me having to take one last exam in order to get my university degree. I'll have to take the exam in the end of July - so I know this will be though to manage but I can still try. Here's the question: can I apply for expedite advance parole? And if so, what reason can I name in the application ? It would be a educational purpose but I can't pick that option on the application. Could I pick 'financial loss' and justify it with not being able to find a 'Good Job' because of my missing degree or could I also put it as 'emergency reasons' ?

Also, I went to my medical examination on October 1st 2013. I was not aware that from that day on the medical examinations will only be valid for 6 months instead of 1 year. Also I did not know that the medical exam has to be valid for the filing for AOS.

Medical exam is valid until march 31st. But I first have to apply for my SSN 2 weeks after my entry and before the wedding. This means that by the time I file for AOS my medical seam will be expired for 2 weeks. Will they send me a RFE for that? Or shall I do another medical examination in New York once I get there ? How long will it take for me to get the results ?

And one last question : can I apply for the SSN after the wedding and receive it before the Gc and before the EAD?

So many questions - I know ... Can anyone help?

I will try and keep my answers to your questions as easy as possible. This is what my gal and I did. when she arrived in the USA after 2 weeks she got her SSN. After we were married, and with the marriage certificate, she got her SSN updated with her married name.

As far as the need for the AP, you can always state the need is for "vacation" purpose. I don't think the USCIS really cares what the purpose is, only that you apply and get the AP in time for what you need it for.

Finally, keep in mind that the USCIS employs people that only know what they read and apply their decisions based on that. You medical is only "valid" for as long as the USCIS says it is. However, you may or may not encounter a USCIS person that will, take common sense into consideration and, allow your medical to be still valid.

Thank you for your answer. I know I can apply for advance parole and I will do so. I am just wondering if my reason will be good enough for an expedite advance parole. Maybe someone else can help me answer that.

I think I'll just do it the 'safe' way and get the medical redone. Better safe than sorry I guess.

Also, maybe someone else can help me with this question: do I need get my name changed on the ssn before filing for AOS?

First, since the I-94 is electronic now, you really do not have to wait for it to be entered into the system like before. Once you can print it out, your information is in the system. Goto the SSA office and get the SSN based on a k-1 visa. After marriage you can TRY to get the name changed using the Marriage Certificate. I say TRY because most SSA workers are not trained well and you will hear that you need to change your name with immigration to the K-1 is no longer valid and you are now on a K-3 visa etc. The name on the SSC is not a problem, the number is what is important. After you get your GC you can then change your name if you so choose.

Second, the medical is valid for 1 year for AOS purposes. The visa is valid based on 6 months after the medical. So you will not need a new medical for filing AOS as long as you do so before October.

Third, file the AOS with the EAD and AP. No reason is needed for the AP. I do not believe you qualify for an expedite, but I also think you will have the AP before July and may even have the GC before July.

Finally, I would apply for your SSN before the wedding in your maiden name. Less change of encountering problems with those poorly trained SSA employees. Then go back after you receive your GC and change your last name. Less trips and more chances of success.

WOW thank you so much! Yu can´t imagine how relieved I am now. I was so worried that things wouldn´t work out as planned but you really helped me with this!

Also I probably would have spent more money on an additional medical exam!

Although I think I still apply for an expedite AP, just in case.

It won´t have any negative effect on my case if the expedite AP doesn´t get approved, is that right?
