Hello everyone, I hope to get something cleared up in my understanding.. Thanks for your help...

At the Kiev Consulate can anyone tell me do they accept co-sponsors on K1 Visa.

I am self employed, normally my income is adequate to be more than 125 % requirement for affidavit of support. however with the economy and bad winter work has been slow. My question is this. Can a private individual ( well off ) write me a letter of employment, stating they will keep me working full time permanently. ?? He has always provided me work during slow times and is sincere in telling me he will always have work for me if there is nothing else available for awhile.

does the Kiev consulate or U.S. Immigration do any research to verify the person writing the letter has sufficient income for this. ? would they want proof like pay stubs or copies of paychecks.. ?

or does the letter of employment have to be from an established business and be on company letterhead and income verified through I.R.S.

In other words what do they do to verify the info in the letter of employment either at consulate or during adjustment of status affidavit of support. ?

Any help / advice is greatly appreciated.

I am not looking to do anything that is not above board. I just need to know all the facts to discuss with the gentleman who I mentioned above so he knows what to tell his accountant.

Also do you have to show assets for 3 years or 5 years for affidavit of support. I have read different sites and they say different things. I know you v-j ers know the real deal. or is it just different for spousal versus fiancé visa and affidavit of support for each.

Nobody can tell you exactly what consulate officer will accept or not for sure. But what about IRS transcripts? Consulate most likely will not really care about your income fluctuations by seasons if your IRS transcripts for last year (better for 3 last years) show that your annual income is substantially above required 125%. Do you meet this requirement?

About amount of years - 1 year is typically minimum, but it's better to show income for last 3 years. They don't care what was before last 3 years at all because they need to see your current financial situation, not what was several years ago.

From what I heard about Moscow consulate (Idk if Kiev will be much different), primary evidence for them are IRS transcripts or other tax documents (W-2 etc.), that's the most important, they care about your taxes, that's why for example people who work for cash and don't pay taxes usually screwed with Affidavit of Support. Other income documents (paychecks, empoyer's letter, checks from customers for contractors...) are often helpful and better to have, but they're only supplemental.

Once again, I'm not specialist and my knowleges mostly apply to Moscow Consulate, but I hope it will help a little bit.

I had a challenging time convincing Government of my income also, I had a couple of RFE's at the AOS stage, had interview last week and wife got her Green Card.

Letter of work commitment will definitely not cut it from my experience unless I am ignorant of the self employed angle. The are looking to extrapolate what ever income you show into an annual income so they can compare to 125% of poverty level. Did your return the last year you filed taxes show adequate income, ie 2012? If so did you show decent income in the 1st half of 2013? Before winter slowdown. If so, show them that as well as the transcript for 2012 and you should be all set until your AOS.

My problem began at the AOS stage where they look a much closer at your income, but at least that will give you another 6 months to come up with a co-sponsor.

My problem was that I too am theoretically self employed, in actuality I am the managing member of multiple LLC's and open up a new business every year so I don't have to pay exorbitant taxes, so my W-2 income is always very high but most years my adjusted gross is negative. My tax returns average 80 pages every year and I knew that the case officer would be totally over their head trying to understand my situation, hence the multiple RFE's in the AOS process.

My girls has interview on 3/24/14. I gave her my 2013 1040 return. I show income above the 125% rule but not too much more. I write off most of my income for obvious reasons. I have my own Real Estate Co. and keep a lot of cash in my bank. My immigration attorney said return would be sufficient but after reading here I wonder if I should send my bank statement. Does anyone have experience here?

My wifa and I went through the K1 process, with her son as a K2 rider. Her K1 was approved through the Kiev Consular office in July 2012, and she arrived in the US in early Nov 2012. We had overwhelming evidence of our relationship (from my 6 trips to see her and meet her family, and a vacation together). We chose not to use an attorney, and due to my wife's detail oriented mind, and the fact that she is a fluent English speaker- PhD linguist), we had zero problems with the process. Vic and Maksym's interview for 'Adjustment of Status' was last week and their GCs arrived today.

As to documents about income- give your fiance what you have that can be verified. The Affidavit of Support I-134 is only an opportunity to submit your case that you can support her. Provide a copy of any contracts you have, bank statements over the past 3 years showing your cash flow in your business, business Articles of Formation, and any other proof you have that ibcome pontential is real.

Also (and very importantly), make sure your fiancee can explain to YOU what your work is and how long you have been in this line of work. If she cannot explain it to you, she will freeze up when the consular official asks about your life. HINT- anything your fiancee does not know about you needs to be covered before the K1 interview. You have just gone through a USCIS background check, and the info packet about you will have a great deal of information.

The Interview takes many hours, as she will have a medical exam and then go to the Consular office at the Embassy and wait. Remind her to be patient and confident.
